Sec. 10-47 Variance Procedures.
   a.   Designation of Variance and Appeals Board. The Board of Zoning Appeals of the Town of Schererville, as established by the Town Council of the Town of Schererville, Lake County, Indiana, shall hear and decide appeals and requests for variances from requirements of this Article.
   b.   Duties of Variance and Appeals Board. The board shall hear and decide appeals when it is alleged an error in any requirement, decision, or determination is made by the Floodplain Administrator in the enforcement or administration of this Article. Any person aggrieved by the decision of the board may appeal such decision to the Lake County Circuit or Superior Court.
   c.   Variance Procedures. In passing upon such applications, the Schererville Board of Zoning Appeals shall consider all technical evaluations, all relevant factors, all standards specified in other sections of this Article; and
      1.   The danger of life and property due to flooding or erosion damage;
      2.   The susceptibility of the proposed facility and its contents to flood damage and the effect of such damage on the individual owner;
      3.   The importance of the services provided by the proposed facility to the community;
      4.   The necessity to the facility of a waterfront location, where applicable;
      5.   The availability of alternative locations for the proposed use which are not subject to flooding or erosion damage;
      6.   The compatibility of the proposed use with existing and anticipated development;
      7.   The relationship of the proposed use to the comprehensive plan and floodplain management program for that area;
      8.   The safety of access to the property in times of flood for ordinary and emergency vehicles;
      9.   The expected height, velocity, duration, rate of rise, and sediment of transport of the floodwaters at the site; and
      10.   The costs of providing governmental services during and after flood conditions, including maintenance and repair of public utilities and facilities such as sewer, gas, electrical, and water systems, and streets and bridges.
