(A) Any owner of registrable property that is vacant and is not registered under § 150.303 shall within ten days after the real property becomes vacant, or within ten days after assuming ownership of the real property, whichever is later, register the real property on the village registry.
(B) Initial registration pursuant to this subsection shall contain at a minimum the name, the mailing address, e-mail address and telephone number of the owner, and if applicable, the name, the mailing address, e-mail address and telephone number of the Property Manager.
(C) At the time of initial registration each registrant shall pay a non-refundable semi-annual registration fee of $300 for each vacant real property. Subsequent semi-annual registrations of defaulted properties and fees in the amount of $300 are due within ten days of the expiration of the previous registration. Said fees shall be used to offset the costs of:
(1) Registration and registration enforcement;
(2) Code enforcement and mitigation related to vacant real properties; and
(3) For other expenses incurred by the village directly related to fulfilling the purpose of this section.
(D) The owner of each individual real property that qualifies as registrable property on the effective date of this section shall have 30 days to register and pay the $300 semi-annual registration fee.
(E) If the real property is sold or transferred, the new owner is subject to all this section. Within ten days of the transfer, the new owner shall register the vacant real property or update the existing registration. The previous owner(s) shall not be released from the responsibility of paying all previous unpaid fees, fines and penalties accrued during that owner's ownership of the vacant real property.
(F) If the vacant real property is not registered, or either the registration fee or the semi-annual registration fee is not paid within 30 days of when the registration or semi-annual registration due, a late fee shall equal 10% of the semi-annual registration fee shall be charged for every 30 day-period, or portion thereof, the vacant real property is not registered and shall be due with the registration. This subsection shall apply to the initial registration and registrations required by subsequent owners of the vacant real property.
(G) Real properties subject to this section shall remain subject to the semi-annual registration requirement and the inspection, security and maintenance standards of this section as long as the real property is vacant.
(H) Failure of the owner to properly register or to modify the registration to reflect a change of circumstances as required by this section is a violation of this section.
(I) If any real property is in violation of this section, the village may take any action to ensure compliance with this section and may place a lien on the real property for the cost of any outstanding obligations and any additional costs incurred to the real property into compliance.

(A) Registrable property shall be kept free of weeds, overgrown brush, dead vegetation, trash, junk, debris, building materials, any accumulation of newspaper circulars, flyers, discarded personal items including, but not limited to, furniture, clothing, large and small appliances, printed material, inoperable vehicles, or any other items causing the regristable property to appear abandoned.
(B) Registrable property shall be maintained free of graffiti or similar markings by removal or painting over with an exterior grade paint that matches the color of the exterior structure.
(C) Front, side, and rear yards, including landscaping, of registrable property shall be maintained in accordance with the property maintenance requirements of the applicable codes.
(D) Pools and spas shall comply with the regulations of the applicable codes.

(A) Registrable property shall be maintained in a “secure manner” so as not to be accessible to unauthorized persons. A “secure manner” shall include, but not be limited to, the closure and locking of windows, doors, gates and other openings of such size that may allow access to the interior of the structure. Broken windows, doors, gates, and other openings of such size that may allow access the interior of the structure must be repaired.
(B) If registrable property has become vacant or blighted, the mortgagee and/or owner shall designate a property manager to bring the registrable property into compliance with the applicable codes and shall regularly inspect the registrable property to verify compliance with the requirements of this section.
(C) Failure of the mortgagee and/or property owner to properly inspect and secure a registrable is a violation of this section.

Any mortgagee and/or property owner or other entity violating any provision of this subchapter shall be fined not less than $100 nor more than $750 for each offense. A separate offense shall be deemed committed on each day which a violation occurs or continues.

(A) Any person, firm, or corporation violating any or all of the provisions of this chapter for which another penalty has not been provided shall be fined an amount not to exceed $500 for each offense. Each day or portion of a day thereof shall be deemed a separate offense in the event such violation continues.

(C) Anyone violating any of the provisions of § 150.076 shall forfeit, upon conviction, to the village not less than $50 or more than $500 for each violation, plus the costs of the action. Each day that such violation continues shall be deemed to be a separate punishable offense.

(D) A violation of § 150.125 is punishable by a fine of not more than $500 for each violation. Each day that the violation continues shall be deemed to be a separate punishable offense.

(E) (1) A violation of § 150.141 is punishable by a minimum fine of $500 up to a maximum fine of $1,000. Each day that the violation continues shall be deemed a separate punishable offense.
(2) In the event that a renewed temporary occupancy permit expires without the necessary corrections being performed, the escrow amount or certificate of deposit becomes the property of the village. The village may use the escrow amount to insure that the structure is brought into compliance with the appropriate codes and ordinances, but no part of the escrow will be refunded. In addition to the forfeiture of the escrowed amount, the fines as noted in division (E)(1) above may also be imposed.

Any contractor or applicant may elect to post a M.P.P. Bond in an amount equal to five times the bond indicated. This bond will cover all of his permits, until the end of the current fiscal year. Any developer may elect to post a M.P.P. Bond in an amount equal to five times the bond indicated. This bond will cover all of his permits in a particular subdivision, until the end of the current fiscal year. The purpose of the bond is to insure protection against damage for all existing public property. | ||
