As used in this chapter:
(a) "Public swimming pool" means any structure, basin, chamber or tank containing a body of water for swimming, diving or recreational bathing and having a depth of two feet or more at any point, other than a private residential swimming pool, intended to be used collectively by numbers of persons for swimming or bathing, regardless of whether a fee is charged for such use, and operated by any person, whether as owner, lessee, operator, licensee or concessionaire.
(b) "Person" means any individual, firm, partnership, association, corporation, company, governmental agency, club or organization of any kind.
(c) "Operator" means the person who is in responsible charge of operating a swimming pool.

(a) No person shall operate or maintain a public swimming pool without first obtaining a permit therefor from the Board of Health. All permits issued by the Board to operate a swimming pool shall expire on April 30 following the date of issuance.
(b) Any person who, subsequent to May 1 of any year, proposes to operate a public swimming pool during any remaining part of the year, shall apply for and obtain a permit therefor from the Board not less than ten days before such public swimming pool is to be opened.

The permit fee for either permit required by Section 868.02 shall be twenty-five dollars ($25. 00) per year or any part of a year.
