As used in this chapter "junk shop" means a building or parcel of real estate in the City which is kept and maintained for the purpose of dealing in waste materials and the purchase and sale of used materials, including papers, rags, rubber, bones and waste materials of every kind.

(a) No person shall operate or maintain a junk shop without first obtaining a license therefor, the annual fee for which shall be seventy-five dollars ($75.00), payable on or before January 31 of each year.

(b) No license shall be granted for the establishment of a junk shop at a new location within the City unless the application for such license is approved by a three-fourths vote of all members of Council.

(c) The Mayor shall issue all licenses required by this section and collect the fees therefor.

No person shall keep or maintain in any junk shop any material offensive to public health, peace or morals. No person operating any junk shop shall use any street for the purpose of keeping thereon, temporarily or otherwise, any materials. All junk shops shall be kept and maintained in a clean and wholesome manner. Any violation of the provisions of this section shall be grounds for the revocation of any license issued to such junk shop or the refusal to grant a license.
