937.07 ADMINISTRATIVE CHARGES.
An administrative charge shall be levied on all users of the sewage treatment works to provide funds necessary to pay a portion of the general government expenses pertaining to the management of the sewage works as allowed by the Ohio Revised Code. Administrative charges for the sewer related cost of building and collection, data processing and engineering shall result in the distribution of all cost related to the management of the sewage works in proportion to the costs of providing such services. The method to be used to establish the administrative charges for sewage discharged to the sewage treatment works shall be defined in this section.
Each user shall be subject to an administrative charge per customer billing, as follows:
(a) Charges for each billing period during a calendar year shall be based upon the following values for that calendar year:
(1) Estimated reimbursable general governmental expenses for the sewer related costs of billing and collection, data processing and engineering.
(2) Estimated total number of nonindustrial and industrial customer billings prepared:
(b) The adminsitrative charge per customer billing for nonindustrial and industrial users shall equal:
(1) Estimated reimbursable general governmental expenses pursuant to subsection (a)(1) hereof, divided by;
(2) Estimated total customer billings pursuant to subsection (a)(2) hereof.

937.08 EXTRA STRENGTH SURCHARGES.
In addition to the base user charge applicable pursuant to Section 937.06, users discharging pollutants to the sewage treatment works of the City whose average concentration, as defined in Section 937.02, in one or more classifications exceeds in any month that concentration defined as normal in Section 937.02 in the corresponding classification, shall be subject to surcharges calculated as follows:
(a) Surcharges for each billing period during a calendar year shall be based upon the following values for that calendar year:
(1) Estimated total operation, maintenance and replacement expenses attributed to the sewage treatment plant pursuant to Section 937.06(a)(1)(Cto);
(2) Estimated total pounds of BOD received at the plant (Bt);
(3) Estimated total pounds of suspended solids received at the plant (St); and
(4) Estimated total pounds of ammonia received at the plant (NHt). Data not available shall be estimated in the most practical manner possible.
(b) Surcharge on user charges per pound of BOD in excess of normal equals:

(e) Pounds of BOD Per billing period subject to surcharge equals (average concentrations of BOD, calculated pursuant to Section 937.02, in milligrams per liter minus 20 milligrams per liter) times volume of sewage discharged from the user to the sewage treatment works per billing period, in 100 cubic feet, times 0.00624. If average concentrations of BOD are 200 milligrams per liter or less, no surcharge for BOD shall apply.
(f) Pounds of suspended solids per billing period subject to surcharge equals (average concentrations of suspended solids, calculated pursuant to Section 937.02, in milligrams per liter minus 240 milligrams per liter) times volume of sewage discharged from the user to the sewage treatment works per billing period, in 100 cubic feet, times 0.00624. If average concentrations of suspended solids are 240 milligrams per liter or less, no surcharge for suspended solids shall apply.
(g) Pounds of ammonia per billing period subject to surcharge equals (average concentrations of ammonia, calculated pursuant to Section 937.02, in milligrams per liter minus 20 milligrams per liter) times volume of sewage discharged from the user to the sewage treatment works per billing period, in 100 cubic feet, times 0.00624. If average concentrations of ammonia are 20 milligrams per liter or less, no surcharge for ammonia shall apply.
(h) Surcharge on user charges equals (pounds of BOD calculated pursuant to subsection (e)) times (surcharge per pound calculated to subsection (b)) plus (pounds of suspended solids calculated pursuant to subsection (f)) times (surcharge per pound calculated pursuant to subsection (c)) plus (pounds of ammonia calculated pursuant to subsection (g)) times (surcharge per pound calculated pursuant to subsection (d)).
(i) Formulas as contained in subsections (b), (c) and (d) hereof shall be subject to adjustment as necessary based upon a biennial audit of sewer revenue fund expenses. Examples for calculating the rate based on formulas set forth herein are attached as Exhibit A to Ordinance 82-039. Surcharges may also be established for pollutants other than those provided for in this paragraph which are permitted to be discharged to the sewage treatment works by the City, after pretreatment, or without pretreatment.

937.09 DEBT SERVICE CHARGES.
A debt service charge shall be levied on both inside and outside City users of the sewage works to provide funds to meet existing and anticipated principal and interest payments on the City's share of sewage works construction cost. An additional debt service surcharge shall also be levied on outside City users of the sewage treatment works to provide funds for repayment to the City for debt service costs on the City's share for certain past sewage treatment works improvements designed with the intent of providing conveyance and treatment capacity to service outside City users. The method to be used to establish the debt service charges for sewage discharged to the sewage treatment works shall be defined in this Section.
The volume of sewage from each inside and outside City user shall be subject to debt service charges per 100 cubic feet as follows:
(a) Charges for each billing period during a calendar year shall be based on the following values for that calendar year:
(1) The current total debt service payments per billing period attributable to the sewage treatment works;
(2) The total debt service payments per billing period attributable to past sewage works improvements designed with allowances provided for contributing sewage flows from outside City users;
(3) The estimated total annual water consumption of users tributary to the treatment works subject to sanitary sewer
charges;
(4) Estimated water consumption subject to sanitary sewer charges, in 100 cubic feet.
(b) The base debt service charge per 100 cubic feet for each inside and outside City user shall equal:
(1) The total debt service payments pursuant to subsection(a)(1) hereof, divided by
(2) The estimated total annual water consumption pursuant to subsection(a)(3) hereof times
(3) Estimated water consumption subject to sanitary sewer charges, in 100 cubic feet pursuant to subsection (a)(4) hereof.
(c) The debt service surcharge per 100 cubic feet for each outside City user shall equal:
(1) The total debt service payments pursuant to subsection (a)(2) hereof, divided by;
(2) The estimated total annual water consumption pursuant to subsection(a)(3) hereof, times;
(3) The estimated water consumption subject to sanitary sewer charges, in 100 cubic feet pursuant to subsection (a)(4) hereof.

(d) Each year after 2026, on the first of the year, the total rates, including the administrative charge in subsection (a)(3), excluding the debt service charges in subsection (b)(2), for each nonindustrial and industrial user inside and outside of the City, including Ontario, shall increase by 3% from the previous year, rounded to the nearest cent if usage charges are in CCF units, rounded to the nearest cent for flat rates in subsection (a)(3) and rounded to the nearest ten thousandths of a cent if usage charges are in Gallons unit.
The sewer charges shall be reviewed at least biennially and shall be revised periodically, as required, to reflect actual sewage works costs. Such increased costs shall be distributed proportionately pursuant to the user charge system. The Public Works Director, or a delegate, shall be responsible for reviewing, retaining of documentation and making recommendations to Council for revising the rates set forth in this chapter. The provisions of this chapter shall take force and be in effect for sewer bills rendered on and after January 1, 2021.

937.12 USERS WITHOUT METERED WATER.
There is hereby established a sewer rate schedule for sewage accounts which do not have metered water supply, as follows:
(a) Nonindustrial user computed on the basis of 8,000 gallons of water usage per month per single family dwelling.
