937.06 USER CHARGES; WASTES OF NORMAL CONCENTRATION.
   A user charge shall be levied on all users of the sewage treatment works to provide funds necessary to pay for the cost of operation, maintenance and replacement of such works. The user charges shall result in the distribution of all costs of operation, maintenance and replacement of the treatment works to each user or user class, in proportion to such user's contribution to the total sewage loading of the treatment works. Factors such as strength, volume and delivery flow rate characteristics shall be considered and included as the basis for the user's contribution to ensure a proportional distribution of operation, maintenance and replacement costs. The method to be used to establish the base user charges for sewage within the limits of normal concentration, as defined in Section 937.02, shall be defined in this section. The method to be used to establish extra strength surcharges for wastes in excess of normal concentrations shall be defined in Section 937.08.
   The volume of sewage from each user shall be subject to a base user charge per 100 cubic feet, as follows:
   (a)   Charges for each billing period during a calendar year shall be based upon the following values for that calendar year:
      (1)   Estimated total operation, maintenance and replacement expenses attributed to the sewage treatment plant including a proportionate share of those costs classified as reimbursable government expenses for engineering, public service and safety, operation and maintenance fund of the City Municipal Building and vehicle insurance costs but excluding all other reimbursable general government and debt service expenses;
      (2)   Estimated total operating, maintenance and replacement expenses attributed to the sewage collection system including a proportionate share of those expenses classified as reimbursable government expenses as set forth in subsection (a)(1) hereof, but excluding all other reimbursable general government and debt service expenses;
      (3)   Estimated reimbursable government expenses of the Bureau of Buildings, Inspections, Licenses and Permits;
      (4)   Estimated annual revenue from extra strength surcharges;
      (5)   Estimated water consumption of users located inside the municipal limits of the City subject to sanitary sewer charges;
      (6)   Estimated water consumption of users located outside the municipal limits of the City subject to sanitary sewer charges;
      (7)   Estimated sums of the water consumption of users located both inside and outside the municipal limits of the City subject to sanitary sewer charges;
   (b)   The base user charge for sewage treatment per 100 cubic feet for each inside and outside City user shall equal:
      (1)   The total operation, maintenance and replacement expenses pursuant to subsection(a)(1) hereof, minus;
      (2)   The estimated annual revenue from extra strength surcharges pursuant to subsection (a)(4) hereof, all divided by;
      (3)   The estimated water consumption subject to sanitary sewer charges in 100 cubic feet pursuant to subsection (a)(7) hereof.
   (c)   The base user charge for conveyance of sanitary sewage per 100 cubic feet for each outside City user of the City sanitary sewer system shall equal:
      (1)   The total operation, maintenance and replacement expenses pursuant to subsection (a)(2) hereof times;
      (2)   The proportionate length of the City sewage collection system required by an outside City user to convey sewage from the municipal limits to the sewage treatment plant for treatment, divided by;
      (3)   The estimated water consumption subject to sanitary sewer charges in 100 cubic feet pursuant to subsection (a)(5) hereof.
   (d)   The base user charge for conveyance of sanitary sewage per 100 cubic feet for each inside City user of the City sanitary sewer system shall equal:
      (1)   The total operation, maintenance and replacement expenses pursuant to subsection (a)(2) hereof, plus;
      (2)   The estimated reimbursable government expenses of the Bureau of Buildings, Inspections, Licenses and Permits pursuant to subsection (a)(3), minus;
      (3)   The revenue received from outside City users pursuant to subsection (c) hereof, all divided by;
      (4)   The estimated water consumption subject to sanitary sewer charges, in 100 cubic feet pursuant to subsection (a)(6) hereof.
      User charges levied pursuant to this section shall be billed pursuant to Section 937.14. The rates shall be as pursuant to Section 937.11.
