Sec. 22.502. Policy and Management.
 
   (a)   The City Council, from time to time, upon recommendation from the appropriate Council Committee or the Mayor, or upon its own initiative, may, by ordinance, establish policies governing the activities of the Department.
 
   (b)   The Department shall be under the control and management of a general manager. The General Manager shall be the Chief Administrative Officer of the Department and the Purchasing Agent of the City.
 
   (c)   The General Manager shall be appointed by the Mayor, subject to confirmation by the Council, as General Manager and Purchasing Agent.
 
   (d)   The General Manager shall designate a Chief Accounting Employee for the Department. The General Manager shall not be designated as the Chief Accounting Employee.
 
   (e)   The General Manager shall be assisted by such assistants and heads of divisions as may be authorized by law.

Sec. 22.503. Powers and Duties.
 
   (a)   The General Manager shall:
 
   (1)   Exercise the powers and duties of General Manager as described in Section 21.1 of this Code, and be responsible, upon the provision of resources, for the administration of those departmental activities duly assigned thereto;
 
   (2)   Have the power to make and enforce rules and regulations necessary for administration of the Department;
 
   (3)   Exercise the powers, duties and functions of Purchasing Agent for the City and purchase all materials, supplies, equipment, and equipment rental and the repair and maintenance services therefor, required for any officer, board or employee of the City, and;
 
   (4)   Have the power to acquire and take by purchase, condemnation or otherwise, in the name of the City, any and all property that may be necessary or convenient for the construction of completion of any facility project enumerated in Sec. 22.500.1;
 
   (5)   Satisfy the bond requirements of Article 3 of Chapter 7 of Division 4 of this Code;
 
   (6)   Have the power to sign all instruments, contracts, warrants, records, certificates, notices, or other documents relating to the acquisition of real property required to be signed or executed.

Sec. 22.504. Acting Purchasing Agent.
 
   The General Manager, as Purchasing Agent, shall designate one assistant or deputy who, in the event of a vacancy in the Office of Purchasing Agent, shall take the oath of office and shall serve in the sole function of Acting Purchasing Agent until a new appointment of General Manager and Purchasing Agent is made in the manner specifically prescribed for that office. The designation shall be in writing made by the Purchasing Agent, filed with the City Clerk, and may be changed from time to time. Any person so designated must possess qualifications prescribed for that office and shall take the oath prescribed by Charter Section 215 before assuming duties as Acting Purchasing Agent.

ARTICLE 4.5
DEPARTMENT TRUST FUND

22.505   [General Services Department Trust Fund.]
 
 
Sec. 22.505. [General Services Department Trust Fund.]
 
   There is hereby established within the Treasury of the City of Los Angeles a fund entitled “The General Services Department Trust Fund” hereinafter in this article referred to as the “Fund.
 
   (a)   The Fund shall be used for the purpose of:
 
   (1)   receipt, retention and disbursement of lease deposits, rental deposits, permit deposits, oil royalty deposits, and any other moneys accepted from persons or entities other than the City by the Department of General Services to assure some future action, and
 
   (2)   for the acceptance and retention of funds by the Department pending their disbursement in part or in full where intended at least in part for a beneficiary other than the City or where funds are deposited temporarily pending resolution of the intent or purposes of a payment.
 
   (b)   The Controller, at the request of the General Manager of the Department of General Services, may designate accounts to be established within the Fund for the classification of various types of receipt or disbursement.
 
   (c)   The Fund shall be administered by, and shall be under the jurisdiction and control of the Department of General Services. Expenditures shall be authorized by, the General Manager of the Department or the designee of the General Manager in accordance with established City practice. No expenditures shall be made from such Fund for purposes which are contrary to the budgetary policy for the Department as established by the Mayor and the City Council.
