For the purposes of this section only, each member of the Corps shall be an employee of the City only while serving any assigned shift as a member or while receiving further training as such, and any person shall be an employee of the City only while receiving any required training to become a member of the Corps.
If any such member or any such person were to suffer or sustain any illness or injury proximately caused by, arising out of, and in the course of, the member’s or person’s service or training while an employee of the City, as hereinabove limited, the member or person shall be entitled to all of those Workers’ Compensation benefits, no more or no less, to which the member or person, pursuant to the provisions of Division 4 of the Labor Code of the State of California but only upon the conditions therein provided therefor, would be entitled if the member or person were a regular police officer receiving a monthly salary as such, provided, however, where such injury or illness occurs in the course of such member’s activities as a disaster service worker, as provided for in Chapter 10 of Part 1 of Division 4 of the Labor Code of the State of California, the provisions of that chapter with respect to compensation shall be controlling.
If any such member or any such person were to die as a result of any illness or injury proximately caused by, arising out of, and in the course of, the member’s or person’s service or training while an employee of the City, as hereinabove limited, those persons who, if the deceased had been a regular police officer receiving a monthly salary as such, would be entitled to any Workers’ Compensation benefits, pursuant to the provisions of Division 4 of the Labor Code of the State of California, shall be entitled, but only upon the conditions provided therefor in said Division 4, to the same such benefits, no more or no less, provided however, where the illness or injury proximately causing the death of such member occurs in the course of said member’s activities as a disaster service worker, as provided for in Chapter 10 of Part 1 of Division 4 of the Labor Code of the State of California, the provisions of that chapter with respect to compensation shall be controlling.

(a) In order to provide special training, including but not limited to professional, technical, physical and academic training, for members of the Police Department of the City of Los Angeles, and for the development of morale and esprit de corps therein, the Board of Police Commissioners of the City of Los Angeles is hereby authorized and directed to inaugurate and conduct such training and other activities within the said Department to the end that the members thereof may most efficiently perform their duties as peace officers of the State of California and as members of the Police Department of the City of Los Angeles.
(b) The Chief of Police shall have the authority to detail members of said Department who have volunteered for special physical training or who have volunteered for special training in academic, technical or professional subjects pertaining to the work of said Department under such rules and regulations as shall be prescribed by the Board of Police Commissioners, and for this purpose it is hereby authorized to provide for training of selected members of said Department with any municipal, State or Federal agency or educational institution which may agree to give such training. Selected members of the Police Department may likewise be detailed for services with other police departments, to study the methods thereof; to acquaint the members of the Police Department so detailed with criminals whose operations extend or may extend into the City of Los Angeles, for the study of new methods of crime prevention and detection, the organization of police departments and the like.
(c) Any such member who is detailed and assigned to take a special training course pursuant to this section shall be required to execute an agreement between the City and such member which shall prescribe the conditions under which the member shall be required to repay the City for the cost of such training, course. For the purposes of this section, a special training course is hereby defined to be such a course which is at least 12 weeks in duration or which requires the City to expend $1,000 or more on behalf of the trainee for registration, tuition, books, equipment, transportation, housing, per diem and similar expenditures.
(d) The Chief of Police is hereby authorized to execute said agreement for and on behalf of the City which agreement shall be substantially in the form set forth below. Such agreement shall not be deemed a contract of employment between the City and the member executing the same.
The standard form of such agreement shall be as follows:
SPECIAL TRAINING AGREEMENT
THIS AGREEMENT made and entered into this ______ day of ___________,19_____ by and between the CITY OF LOS ANGELES, a municipal corporation, hereinafter referred to as CITY, and (Name of Member) , a member of the Los Angeles Police Department hereinafter referred to as MEMBER.
WHEREAS, training is needed for certain personnel in the Police Department and the training of said personnel in (Type of Training) will promote efficiency and economy in law enforcement; and
WHEREAS, Special Training is available through (Name of Institution Offering Training) which will provide the necessary skills and abilities to said member in the field of (Special Area) and
WHEREAS, (Name of Member) has been assigned to take the Special Training Course herein for which funds have been provided.
NOW, THEREFORE, the parties herein agree as follows:
1. City agrees to pay for a Special Training Course to the extent it is not so provided by the outside Agency or Institution offering the training.
2. Member shall be paid their normal salary for their job classification while taking the Special Training Course herein referred to upon the basis of an eight (8) hour day, forty (40) hour week without any compensation for overtime or other adjusted compensation or premium pay based upon time spent in taking such Special Training Course.
3. Both the member and the City contemplate that upon completion of the Special Training Course, the member will remain in the employ of the City for some reasonable period of time during which the member’s newly acquired skills and knowledge will be utilized for the benefit of the City. Both the member and the City recognize that while the member is attending said course, the member is of limited value to the City. Both the member and the City agree that it is difficult to ascertain the loss which the City would sustain in the event said member, upon completion of the course, failed to remain in the employ of the City for a reasonable period of time. Therefore, the member and the City agree that if the member fails to remain in the service of the Police Department for three years after completion of a Special Training Course, but leaves by reason of voluntary retirement or resignation the member shall reimburse the City in the form of reasonable liquidated damages in an amount equal to one-half (1/2) the member’s monthly salary multiplied by the number of months or fractions thereof during which said member received special training plus the amount actually expended by the City for tuition, books and related costs of the Special Training Course; the amount thus established shall be reduced by two and seventy-five hundredths percent (2.75%) for every month or fraction thereof that the member remains with the Los Angeles Police Department following completion of the Special Training Course.
4. If member leaves the service of the Department because of death, prolonged illness, disability, or similar eventualities beyond the member’s control or because of termination for cause, said obligation to reimburse the City shall be deemed satisfied and member shall make no more payments to the City.
5. This Agreement shall not be deemed to be or construed as a contract of employment between the Parties hereto.

For the purpose of increasing the proficiency of members of the Police Department in the use of firearms the Board of Police Commissioners is hereby authorized and directed to prescribe such course of training in the use of firearms as it in its judgment deems proper, and may promote and conduct competitive contests in the use of such arms. It shall have power to authorize or require members of the Department to engage in competitions in the use of arms both within and without the State. The Board of Police Commissioners may in its discretion grant leave with pay to selected members of the Department while engaged in such competition; provided, however, that details for such duty shall be so arranged so as not to prejudice the efficient performance of duty within the Police Department.

When any such detail is made under the terms of this article involving the absence of a member of the Police Department from the State of California, notice of such detail shall be given to the Board of Fire and Police Pension Commissioners and the Workers’ Compensation Division of the City Attorney’s Office. No such detail shall be made in any case where the absence of the said member of the Police Department from duty within the City of Los Angeles would be prejudicial to the public interest, nor where funds are not available for that purpose.

The Chief of Police of Los Angeles is hereby authorized to permit persons who are members of any other police Department, sheriff’s Department, or other Federal, State, County or City department, or members of any other organization having to do with the public safety, to attend the classes and sessions of the Police Training Program of the Los Angeles Police Department, upon payment of the fees prescribed therefor.
