844.13   CONTROL GATE, CASING STIPULATION AND DRILLING.
   (a)   It shall be the duty of any person in the drilling of a well to provide for a drilling control gate, which shall be so constructed as to effectively cut off the flow of gas at the top of the well and which can be operated at a point remote from the well.
   (b)   In any event all casing which is inserted into a gas or oil well shall be so constructed as to withstand pressure of at least 2, 000 pounds per square inch.
   (c)   The annular space between the casing and well wall shall be filled from below the Big Injun sand to the surface with prepared clay, cement, rock sediment or bentonite to prevent any migration of water. If bentonite is used, the mixture shall be not less than two parts bentonite and one part ground fire clay and shall be circulated under pressure to the top of the hole.
   (d)   The mixture provided for in subsection (c) hereof shall apply in the mudding of the Berea grit casing.

844.14   ABANDONMENT OF WELL.
   In the event that a well is abandoned, it shall be the duty of the owner or lessee to notify the Director of Public Service who shall then advise the City Engineer of such abandonment, and the same shall be indicated on the map provided at the time of the original application.

844.15   SEALING OF WELLS.
   It shall be the duty of the applicant to seal gas and oil wells to protect fresh water wells from salt water pollution. To that end the applicant shall notify the State Division of Mines of his intention to plug or abandon a well and the mudding and plugging shall be done under the supervision of a representative of the State Division of Mines, in one of the following methods:
   (a)   The Casing Method consists of setting a string of casing between the potable water (Injun) and the sale water (Berea). This string of casing is to remain in place during the life of the well, unless another approved method of separation is used.
   (b)   The Casing Packer Method consists of setting a string of casing through the sale water (Berea) with a packer between the potable water (Injun) and the sale water (Berea). Prepared mud should be added on top of the packer after completion. This string of casing is to remain in place during the life of the well, unless some other approved method of separation is used.
   (c)   The Casing Bentonite-Clay Method consists of setting a string of casing through the sale water (Berea) and filling outside the casing with bentonite-clay by circulating under pressure, before further drilling is done. This string of casing is to remain in place during the life of the well, unless some other approved method of separation is used.
   (d)   If a well is found productive, the ten-inch casing set through the Big Injun sand is withdrawn and replaced by an eight-inch string of casing with a ten-inch Swage attached to the bottom. The annular space between the eight-inch casing and the wall of the hole on top of ten-inch Swage shall be filled with ground prepared Fire Clay to the surface.
   (e)   A bridge shall be set above the top water in the Big Lime and sufficient fill made to support the setting of a lead plug between the top water in the Big Lime and the top of the Big Lime. The hole immediately above such lead plug shall be filled to 200 feet with prepared clay, rock sediment or cement.
   (f)   The hole shall be filled from the top of the plug immediately above the Berea sand to the surface with prepared clay, rock sediment or cement.

844.16   HAULING OF EXPLOSIVES.
   Except as otherwise provided in the General Offenses Code, in the Fire Prevention Code or elsewhere in these Codified ordinances, no person shall haul, cart, carry or convey any explosives in any manner over the streets or other public ways of the City without first obtaining a permit therefor from the Director of Public Service. The Director is hereby authorized to establish routes over which such explosives may be conveyed. The person in charge of the operation of the conveyance of explosives shall carry with him at all times, while in the act of conveyance, the permit issued for such purpose, which permit shall set forth the route and destination of the explosives.

844.17   HOURS FOR DRILLING.
   Drilling shall be permitted twenty-four hours per day but no driller may dress tools, sharpen bits or operate his forge between the hours of 10:00 p. m. and 7:00 a. m. of the following day in any area where there are inhabited dwellings located within 500 feet of the drilling operation.

844.18   APPLICATION OF CHAPTER.
   If any owner, lessee, contractor or other person engaged in the drilling of gas or oil wells, as provided in this chapter, has commenced the drilling of any oil or gas well prior to the effective date of this chapter (Ordinance 64-40, passed June 16, 1964), the provisions of Sections 844. 01 to 844. 12, inclusive, shall not apply to such well. All other sections of this chapter shall be in full force and effect and applicable to such wells and to the operations incident thereto. Within the meaning of this chapter, a gas or oil well shall be deemed commenced when there is in existence a valid and subsisting lease, which has become a matter of public record, contract or other agreement in writing providing for the drilling of such oil or gas well and the driller, contractor or other person engaged in such operation has placed his rigging and equipment on the premises specified in his agreement, lease or contract and has begun to erect his rig for the purpose of drilling such oil or gas well.

844.19   ENFORCEMENT.
   The enforcement of this chapter and all other applicable laws and ordinances of the City shall primarily devolve upon the Director of Public Service. However, the Departments of Police, Fire and Health shall also be charged with the enforcement of this chapter and shall, so far as possible, act in connection with the Director. Nothing herein contained shall be construed to exempt any other City officer or department from any obligation that may be required by law.
