The purpose and intent of this chapter is to provide a uniform and comprehensive set of regulations and standards for the permitting, development, siting, installation, design, operation and maintenance of small wireless telecommunications facilities ("Small Cell Facilities" or "SWF") in the City of Chico's ("City") public right-of-way ("PROW"). These regulations are intended to prescribe clear and reasonable criteria to assess and process applications in a consistent and expeditious manner, while reducing the impacts associated with wireless telecommunications facilities. The City recognizes the importance of Small Cell Facilities to provide high-quality communications service to the residents and businesses within the City, and the City also recognizes its obligation to comply with applicable federal and state laws. This chapter shall be constructed and applied in consistency with the provisions of state and federal laws, and the rules and regulations of the Federal Communications Commission ("FCC") and the California Public Utilities Commission ("PUC"). In the event of any inconsistency between any such laws, rules and regulations and this chapter, the laws, rules and regulations shall control.
