Notwithstanding the provisions of this chapter to the contrary, a permit shall not be required for the following events conducted in a city park facility:
A. Any event conducted in a city park facility or portion of such park facility which is sponsored or carried out by another public agency, a private organization, or an individual that has a lease or other agreement between the city and such public agency, private organization or individual for the exclusive use of a city park facility;
B. Any event conducted in a city park facility or portion of such park facility which the agency, organization or individual operating the Chico Creek Nature Center is the sole organizer and sponsor of the event and in which the predominant purpose of the event is for the education and observation of park vegetation, wildlife, streams, geological formations and other natural resources.
C. Any event held for the purpose of exercising free speech rights, as defined in Section 12R.10.010(D), and that does not include any of the following:
1. Food and beverage sales or consumption, or the selling of any goods;
2. Admission charges or solicit donations.
3. Setting up any tents, tables, structures, or the use of electricity or other park or City resources.
4. Exclusive use of or access to the event location.
