242.23 EDUCATIONAL INCENTIVE.
   (a)   Any full-time employee within the Department of Police, who has obtained an Associate's Degree in political science shall receive six hundred fifty dollars ($650.00) additional compensation annually, prorated in the year of completion. This compensation shall be paid in the first pay period of December.
   (b)   Any full-time employee, excluding employees within the Department of Fire, who has obtained a Bachelor's Degree in Police Science or a Police-Science related degree, shall receive a total of one thousand dollars ($1,000.00) additional compensation annually, prorated in the year of completion. This compensation shall be paid in the first pay period of December.
   (c)   Educational incentive for employees within the Department of Fire is addressed under Chapter 246 of these Codified Ordinances.

242.24 PROFESSIONAL LIABILITY INSURANCE.
   The City will provide professional liability insurance, if available, for each employee, at City expense, with limits of one million dollars ($1,000,000) per person and per incident. This coverage will protect the employee from any liability which may arise as a result of his or her law enforcement duties.

242.25 POLICE AND FIRE COMMUNICATIONS DISPATCHERS.
   (a)   There are hereby established the following positions in and for the City:
      (1)   Police and Fire Communications Dispatcher, Class One; and
      (2)   Police and Fire Communications Dispatcher, Class Two.

   (b)   A Dispatcher, Class One, shall be employed forty hours per week and shall perform duties relating to the reception and transmission of police and fire communications, which duties shall be more specifically prescribed by the Director of Public Safety. (Adopting Ordinance)
   (c)   A Dispatcher, Class Two, shall work as needed but not to exceed thirty-five hours, and shall perform duties relating to the reception and transmission of police and fire communications, which duties shall be more specifically prescribed by the Chief of Police.

   (d)   The Director shall appoint Dispatchers Class One and Class Two and shall provide rules and regulations related to the duties of such Dispatchers.

   (e)   The expense of salaries of Dispatcher, Class One, and Dispatcher, Class Two, shall be borne 80% by Police, and 20% by Emergency Rescue of the City. Such salaries shall be determined from time to time by Council.

   (f)   Any radio or other electronic equipment owned by the City, placed in premises owned by a Dispatcher, Class Two, shall be subject to removal by the Director, at his or her discretion.

242.26 SECRETARY/DISPATCHER FOR THE POLICE DIVISION.
   (a)   There is hereby established the position of Secretary/Dispatcher for the Police Division. The Secretary/Dispatcher shall be under the direct supervision of the Chief of Police, shall augment and supplement the present police force and shall be primarily responsible for providing coverage for clerical duties, communications and information for both the Police and Fire Divisions. This person shall operate and control the communications system for both the Police and Fire Divisions, keep up-to-date files needed by such Divisions, type necessary forms, letters and correspondence and perform any other duties which may be required by the Chief of Police. This person shall maintain contact with and dispatch cruisers as required, sound fire alarms and notify the Fire Division and the Chief of Police of the location of fires, answer incoming inquiries in a courteous and effective manner, maintain accurate records and files of all activity pertaining to the function of his or her office, and have charge of the City Jail, providing care, food, protection and safety as required for prisoners until they are transported to the County Jail. As directed by his or her superior, the Secretary/Dispatcher may carry firearms only in cases of extreme emergency. He or she shall also maintain radio contact on a County-wide basis, replace the Dispatcher, Class Two, if necessary, and perform the duties of dispatcher and jailer when called in.

   (b)   The Secretary/Dispatcher shall be compensated as determined by Council from time to time.
242.27 PERSONNEL FILES; DISCIPLINE.
   (a)   Understanding that in the administration of the Department of Public Safety the employer maintains individual personnel files, employees may, and on an annual basis be permitted to, review their personnel files with at least a five-day written request therefor. In addition, a Department member may inspect his or her personnel file in direct response to a pending grievance or official matter.
   (b)   If an employee, upon review of his or her file, comes across material of a negative or derogatory nature, such employee may provide a written and signed comment in rebuttal, mitigation or explanation of such material, which comment shall remain in the employee's file so long as the negative material remains.
   (c)   When a Department member is charged with or is under investigation for contended violations of Departmental rules and regulations, reasonable efforts, consistent with applicable law, shall be made to withhold publication of the officer's name and the extent of disciplinary action taken or contemplated until such time as a final interdepartmental ruling has been made and served upon the officer. If any of the aforementioned are leaked to the media, it will not negate the employer's right to proceed with the matter at hand.
   (d)   The release of photographs or personal information about any officer in relation to Departmental matters shall not be provided to any news or related service without prior consent of the subject officer.
   (e)   Written reprimands will be removed from the file and destroyed upon the request of the officer two years after such were given if no further disciplinary action has occurred.

242.28 INTERPRETATION.
   The provisions included in this chapter are meant to conform to and should be interpreted in conformity with applicable Federal and State laws and Civil Service rules and regulations. If any provision of this chapter is found invalid, all other provisions shall remain in force and effect.

242.29 FRINGE BENEFITS FOR FULL-TIME, EXEMPT POLICE DIVISION EMPLOYEES.
   (a)   Sections 242.05, 242.08, 242.09, 242.10, 242.11, 242.12, 242.13, 242.14, 242.18, 242.22, and 242.23 are inapplicable to full-time employees of the Police Division subject to this chapter who are exempt from the collective bargaining agreements.
   (b)   Full-time employees of the Police Division subject to this chapter who are exempt from the collective bargaining agreements shall receive fringe benefits equal to, and as defined in, the current collective bargaining agreement between the City and the Fraternal Order of Police, Ohio Labor Council, Inc.
   (c)   Any changes in health insurance benefits provided by the passage of this section shall be effective upon the date of the next payroll following passage, and not retroactively.
