Every person appointed to serve in any capacity in the county ESDA shall, before entering upon his or her duties, subscribe to the following oath as set forth in ILCS Ch. 20, Act 3305, § 20, which shall be filed with the Coordinator:
I, , do solemnly swear (or affirm) that I will support and defend and bear true faith and allegiance to the Constitution of the United States and the Constitution of the state, and the territory, institutions and facilities thereof, both public and private, against all enemies, foreign and domestic; that I take the obligation freely without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties upon which I am about to enter. And I do further swear (or affirm) that I do not advocate, nor am I nor have I been a member of any political party or organization that advocates the overthrow of the government of the United States or of this state by force or violence; and that during the time as I am affiliated with the county ESDA organization, I will not advocate nor become a member of any political party or organization that advocates the overthrow of the government of the United States or of this state by force or violence.

The County Board may make an appropriation for ESDA purposes in the manner provided by law under ILCS Ch. 20, Act 3305, § 10, and may levy in addition for ESDA purposes only, a tax not to exceed $0.05 per $100 of the assessed value of all taxable property in addition to all other taxes, as provided by ILCS Ch. 20, Act 3305, §§ 11 et seq.; however, the amount collectible under the levy shall in no event exceed $0.25 per capita.

ENVIRONMENTAL CONTROL BOARD
(A) There is created an agency to be known as the County Environmental Control Board.
(B) The members of the Environmental Control Board shall be the Health Officer of the County Health Department, and eight members who shall be appointed by the Chairperson of the County Board, with the advice and consent of the County Board, as follows:
(1) One shall be a registered professional engineer as defined in the State Professional Engineering Act filed July 24, 1941, as amended, who is experienced in the field of air pollution control;
(2) One shall be a physician, licensed in compliance with the Medical Practice Act approved June 30, 1923, as amended, who shall be experienced in the field of industrial medicine;
(3) One shall be engaged in a field which directly relates to agriculture or conservation;
(4) One shall be actively engaged in the management of a private manufacturing concern;
(5) One shall be representative of labor;
(6) One shall be engaged in municipal government; and
(7) Two others shall be selected at large.

(A) The appointed members’ terms of office shall be four years and until their successors are selected and qualified; however, the terms of those first appointed shall expire as follows:
(1) Two at the end of one year after date of appointment;
(2) Two at the end of two years after date of appointment;
(3) Two at the end of three years after date of appointment; and
(4) Two at the end of four years after date of appointment as designated by the Chairperson of the County Board of Supervisors at the time of appointment. The terms of all members shall continue until their respective successors have been duly appointed and qualified.
(B) If a vacancy occurs in the appointed membership, the Chairperson of the County Board may, with the advice and consent of the Board, appoint a member for the remaining portion of the unexpired term created by the vacancy. The Chairperson of the County Board may, with the advice and consent of the Board, remove any appointed member for cause.
(C) The members of the Environmental Control Board shall receive no compensation for their services, but shall be reimbursed for expenses necessarily incurred in the performance of their duties.

(A) The Environmental Control Board shall hold at least four regular meetings each calendar year at a place and time to be fixed by the Board. Special meetings may be called by the Chairperson or by three members of the Board. Five members of the Board shall constitute a quorum.
(B) The Board shall select at its first meeting one of its members to serve as Chairperson and another of its members to serve as Vice-Chairperson. At the first regular meeting in each calendar year thereafter, the Chairperson and Vice-Chairperson for the ensuing year shall be elected. The Chief Sanitarian of the County Health Department shall be technical secretary of the Board. He or she shall receive no additional compensation for his or her services.
