167.16   TEMPORARY, PART-TIME AND SEASONAL EMPLOYEES.
   (a)   Whenever an emergency exists which requires that a vacancy be filled at once, in order to help maintain the health, safety, welfare and public services of the City, the Personnel Director may appoint any qualified person to temporarily perform the duties of the vacant position. However, such temporary employee must take the appropriate entrance examination and must successfully pass such examination in order to be permanently appointed. The temporary employee shall be terminated if he or she fails the examination, and in no case shall such temporary employment exceed six months.
   (b)   The Personnel Director may appoint seasonal and part-time employees as he or she, in his or her discretion, deems necessary to supply or maintain public services without regard to the provisions of Sections 167.11, 167.12, 167.13 or 167.14.
   (c)   A part-time employee is one who is hired to work regularly less than seventy hours bi-weekly. In regard to Police Division employees, the negotiated labor agreement shall control in regard to Division of Fire employees, except for firefighter/EMT shift supervisors, the Chief and the Assistant Chief, all employees and volunteers shall be considered part-time for the purpose of determining eligibility for benefits.
   (d)   A seasonal employee is one who is hired to work regularly for a given season, not to exceed five months.
   (e)   Except as otherwise expressly provided, no temporary, part-time or seasonal employee shall be entitled to any of the benefits described in Section 167.04, 167.05, 167.06, 167.09, 167.36, 167.37 or 167.38.
