167.04   OVERTIME.
   (a)   It shall be the policy of the City to keep to minimum all work in excess of the established schedule and to permit such work only when it is necessary to meet urgent City operating requirements. Overtime shall be scheduled only upon approval of the City Manager or persons designated by him or her in writing. Overtime shall be equalized among qualified employees as nearly as possible.
   (b)   Compensation for overtime shall be certified by the City Manager according to the following:
      (1)   All overtime will be paid at a rate of one and one-half times the hourly rate of the employee. There shall be no duplication or pyramiding of any premiums for the same hours worked.
      (2)   All overtime will be paid in accordance with all hours worked over the maximum number of allotted hours per the designated work period. The maximum hours per designated work period are set forth below:
         A.   All full-time personnel, nonexempt from coverage under the Fair Labor Standards Act, 40 hours in a seven-day work period.
         B.   Firefighter/EMT shift supervisors as set forth in the collective bargaining agreement between the City and the International Association of Firefighters, Local 4468. Volunteer firefighters and rescue personnel, 212 hours in a 28-day work period;
         C.   Sergeants, police officers and police dispatchers as set forth in the collective bargaining agreement between the City and the Fraternal Order of Police, Ohio Labor Council, Inc.
      (3)   When an employee, other than a police officer, police dispatcher or firefighter/EMT shift supervisor, has been called out for additional work after having worked his or her regularly scheduled hours and after having reported off-duty, he or she shall be paid for a minimum of two hours at time and one-half the employee's regular rate, for reporting, whether or not two full hours are worked. However, when an employee is requested to report early for his/her shift, the employee shall be paid only for actual time worked at time and one-half the employee's regular rate. Call-out pay for police officers, police dispatchers, and firefighter/EMT shift supervisors shall be governed by the terms of their respective collective bargaining agreements.
      (4)   Overtime for court appearances by sergeants, police officers and dispatchers shall be controlled by their collective bargaining agreement.
      (5)   No department or division head shall receive overtime compensation, except in an emergency which affects the health, safety and welfare of the Municipality and its inhabitants, and such overtime shall be allowed only with the approval of the City Manager.
      (6)   Non-worked hours which are paid by the City, including, but not limited to, holidays, sick leave, vacations, personal days and jury duty pay, shall not be included as hours worked during the pay period for the calculation.
      (7)   The calculation of overtime for firefighter/EMT shift supervisors shall be governed by the terms of the collective bargaining agreement between the City and the International Association of Firefighters, Local 4468.
      (8)   Injury-in-the-line-of-duty pay shall be included in the calculation of overtime.
   (c)   A complete listing of all overtime shall be kept by the appropriate department or division head, and all overtime shall be reported to the City Manager on forms and in accordance with procedures specified by the City Manager.
