7-1-7: NEW BUILDINGS; CURBS AND SIDEWALKS REQUIRED:
   (A)   It is the purpose and intent of this section to establish the policy and procedure that no new buildings for residential or business purposes shall be erected without the construction of curbs, gutters and sidewalks and being installed in conjunction with the construction of such buildings.
   (B)   No building permit for the construction of any building for residential or business purposes shall hereafter issue unless the application therefor contains an adequate description of the plans and specifications for the construction and installation of curbs, gutters and sidewalks.
   (C)   If sixty percent (60%) or more of the total property length adjacent to the property on a standard block does not have existing curb and gutter, the construction of curb and gutter may be deferred unless it will connect to an existing curb and gutter section. Calculation of the amount of existing curb and gutter shall include the length of the property in question. The standard block shall be the distance between two (2) intersecting streets or four hundred feet (400'), whichever is less. This same sixty percent (60%) criteria shall separately apply to the requirement for sidewalks. All curb and gutter to be considered as existing shall be to acceptable line and grade.
   In the event it appears that this subsection is applicable, the application for building permit shall contain a covenant by the applicant that the construction of such curb, gutter and sidewalk shall be constructed by the applicant or his successors in interest upon demand by the city. Demand may be made by the city at any time when it appears that buildings have been constructed upon sixty percent (60%) or more of the block as first herein provided, whether or not curb, gutter and sidewalks have been constructed in connection therewith.
   (D)   All such curbs, gutters and sidewalks shall be constructed and installed in accordance with the provisions of this chapter and title 4, chapter 1 of this code, and such provisions are hereby amended, respectively, to the extent necessary to effectuate the purposes and intent of this section.
   (E)   Any person violating any of the provisions of this section shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which the violation of the provisions of this section is committed, continued or permitted.
