8-1-4-6: PROPERTY MAINTENANCE CODE:
   A.   Code Adopted: A certain document, three (3) copies of which are on file in the office of the building and zoning officer, of the village of South Barrington, being marked and designated as the 2003 international property maintenance code, as published by the International Code Council Inc., is hereby adopted as the property maintenance code of the village of South Barrington, in the state of Illinois, for regulating and governing the conditions and maintenance of all property, buildings, and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary, and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said property maintenance code on file in the office of the village of South Barrington are hereby referred to, adopted, and made a part hereof, as if fully set out in this section, with the additions, insertions, deletions, and changes, if any, prescribed in subsection B of this section.
   B.   Additions, Insertions, And Changes: The international property maintenance code is amended and revised in the following respects:
      Section 101.1 - Title: Insert the words "the village of South Barrington" to replace the words "(name of jurisdiction)".
      Section 103.5 - Fees: This section is hereby reserved.
      Section 104 - Duties And Powers Of The Code Official: Any reference to "code official" shall be taken to mean the building and zoning officer of the village of South Barrington.
      Section 106.4 - Violation Penalties: Delete the phrase "shall be prosecuted within the limits provided by state or local laws" and substitute "shall be fined not less than fifty dollars ($50.00) nor more than seven hundred and fifty dollars ($750) for each offense".
      Section 304.14 - Insect Screens: Insert the dates "May 1st to November 1st" to replace the words "(date) to (date)".
      Section 602.3 - Heat Supply: Insert the dates "October 1st to May 1st" to replace the words "(date) to (date)".
      Section 602.4 - Occupiable Work Spaces: Insert the dates "October 1st to May 1st" to replace the words "(date) to (date)".

8-1-5: BUILDING PERMIT:
   A.   Permit Required: It shall be unlawful to construct, enlarge, alter, remodel, remove, structurally repair or demolish a building, accessory building or structure or change the occupancy of a building from one use group to another requiring greater strength, exitway or sanitary provisions or to change to a prohibited use or to alter a building in any manner affecting a bearing wall or bearing partitions, the outside walls or the roof or to install or alter any plumbing or electrical work, or to install a driveway, or to excavate, move, spread, shape or import more than fifty (50) cubic yards of earth, or to install or alter any equipment for which provision is made or the installation of which is regulated by the building ordinance of the village without first filing an application with the building department and obtaining the required permit therefor; except, that ordinary repairs which do not involve any violation of the building ordinance shall be exempt from this provision.
   B.   Construction Documents: When deemed appropriate by the village building and zoning officer because of the proposed project scope, site topography, or infrastructure ramifications, no building permit shall be issued for any construction or alteration exceeding fifty thousand dollars ($50,000.00) in cost unless the application therefor be accompanied by construction documents approved and sealed by a licensed architect or structural engineer, registered in the state.
   C.   Site Plan: Whenever any work shall alter or cause or permit the alteration of any existing land grade, contour or drainage pattern in any manner, there shall be submitted five (5) copies of site drawings. These site design drawings shall be signed by the author of said plans and may be required to be sealed by an appropriate design professional registered in the state of Illinois and at a minimum conform to the appropriate requirements described in section 4-7-2, 905.190 of this code.
   D.   As Constructed Documents: Projects requiring site plans, after the completion of the proposed improvements, shall be required to have as built site plans prepared. Three (3) copies of the as built site plan shall be submitted to the Village for review. The as built plans shall be signed by the author of said plans and may be required to be sealed by an appropriate design professional or land surveyor registered in the State of Illinois. The as built plans shall accurately describe all proposed improvements. The as built grades shall be shown to be within one-tenth of a foot (0.1') of the approved plan unless approved in writing. The as built plan shall be approved prior to the project receiving final approval and the return of the permit holder's performance deposit monies. If the as built plan is not received within sixty (60) days of receiving a conditional occupancy, the Village may have an as built survey completed with the cost of the survey deducted from the performance deposit.    E.   Application Fee: The following application fees are applicable to all residential and nonresidential building permits:

   F.   Review And Inspection Fees: Review and inspection fees for on site improvements, site plan, or as built plan reviews, which require the review of the Village Engineer, shall be billed at the cost of the consulting engineer plus ten percent (10%) for administrative handling. 8-1-6: FEES AND DEPOSITS:
8-1-6-1: PERMIT, INSPECTION AND PLAN REVIEW FEES:
   A.   Fees For Residential Construction:
      1.   New House Construction: The basic building permit fee shall be ten dollars ($10.00) for each one thousand dollars ($1,000.00) of scaled cost of construction, or fraction thereof, with the scaled cost of construction being determined using the following cost factors:

For determination of building permit fees, the gross floor area of each type of space listed above shall be computed using the outside dimensions indicated on the blueprints as submitted by the applicant.
Basic permit fee shall be the sum of each product which applies from the above listing plus:

      2.   Addition, Alteration, Finishing Or Remodeling: The scaled cost of construction for any addition, alteration, finishing or remodeling of the above categories of work shall be determined at the same rate as the scaled cost of construction of the existing space would be determined if new. For proposed work not conforming to the square foot method of calculation shown in subsection A1 of this section, the rate of ten dollars ($10.00) for each one thousand dollars ($1,000.00) of actual cost of construction, or fraction thereof, with the actual cost of such work to be substantiated by a copy of the signed contract(s) for such work. The Village shall have the right to substitute its own estimated cost of construction figures when it feels those being provided by the applicant are unrealistic.

      7.   Subdivision Entrance Structure: When required by the Plan Commission/Zoning Board of Appeals during final plat approval, a building permit fee of twenty five dollars ($25.00) shall be charged for each entrance gateway/identification structure indicated on the approved development plans. Other structures to be built by the developer, other than those itemized in subsections A3 through A6 of this section, shall be charged at the rate of ten dollars ($10.00) for each one thousand dollars ($1,000.00) of actual cost of construction, or fraction thereof, with the actual cost of such work to be substantiated by a copy of the signed contract(s) for such work.       8.   Septic Repair; Fee: In the event a septic repair or alteration must be made or in the event of a septic failure, the permit fee for the necessary repair work shall be as follows:

The Village will also be reimbursed by the owner of the property on which said repairs are made for any costs associated with the project, including, but not limited to, court costs, laboratory work or expert testimony. (Ord. 0-2015-1077, 7-9-2015)
      9.   Temporary Driveway: The fee for a temporary driveway permit shall be charged whenever primary or secondary access must be provided across a ditch line to a site in conjunction with any category of building construction indicated herein or for other purposes as the property owner may determine, as follows:

      10.   Driveway Paving/Repaving: In addition to the basic driveway permit fee, the culvert(s), if any, must be inspected by the Village Engineer prior to the start of any paving work. This culvert inspection shall be in addition to any which were performed at the beginning of the project. Any paving work done without the required culvert inspection will be done at the risk of the contractor if it is later determined that adjustments to the pitch or elevation of the culvert pipes are necessary.

      13.   Surcharge For Construction Without A Permit: In addition to all fees otherwise provided for herein, a fee surcharge of fifty percent (50%), but not less than one hundred dollars ($100.00) nor more than five thousand dollars ($5,000.00), shall be assessed if construction is started before the necessary permit(s) is obtained.
      14.   Re-Inspections: Whenever re-inspection of any construction work is required due to the failure of the work to meet the requirements of any ordinance of the Village, a re-inspection fee of eighty five dollars ($85.00) shall be paid to the Village prior to the performance of the re-inspection.
      15.   Plan Review Fees When Payment Due: All plan review fees shall be paid when the building permit application is submitted for review. (Ord. 0-2017-1148, 3-9-2017)
   B.   Fees For Nonresidential Construction 1 :
      1.   Subdivision Entrance Structure: When required by the Plan Commission/Zoning Board of Appeals during final plat approval, a building permit fee of one hundred fifteen dollars ($115.00) shall be charged for each entrance gateway/identification structure indicated on the approved development plans. Other structures to be built by the developer and/or applicant, including, but not limited to, gatehouses, waterfalls or outbuildings, shall be charged at the rate of ten dollars ($10.00) per one thousand dollars ($1,000.00) of actual construction cost, or fraction thereof.
      2.   Surcharge For Construction Without A Permit: In addition to all fees otherwise provided for herein, a fee surcharge of fifty percent (50%), but not less than two hundred eighty five dollars ($285.00) nor more than ten thousand dollars ($10,000.00), shall be assessed if construction is started before the necessary permit(s) is obtained.
      3.   Re-Inspections: Whenever re-inspection of any construction work is required due to the failure of the work to meet the requirements of any ordinance of the Village, a re-inspection fee of eighty five dollars ($85.00) shall be paid to the Village prior to the performance of the re-inspection.
   C.   Fees Applicable To Both Residential And Nonresidential Construction:
      1.   Moving Or Raising Existing Structure: In addition to the permit fee for the necessary new foundation, a fee of three hundred fifty dollars ($350.00) shall be charged to permit the moving or raising of a building or structure from one (1) lot to another or to a new location on the same lot.
      2.   Demolition Of Existing Structure: The fee for a permit for the demolition of a building or structure shall be charged at the rate of ten dollars ($10.00) per one hundred (100) square feet, or fraction thereof, of the gross floor area, including basement and garage (if any), of the building or structure being demolished.
      3.   Site Development Permit: The site development permit fee shall be charged whenever any excavation, clearing, mining, filling, moving, spreading, shaping, exporting or importing of more than fifty (50) cubic yards of earth, gravel, landscaping or construction debris takes place on any parcel of property within the Village, whether vacant or developed, and shall be charged as follows:

      4.   Removal Of Stop Work Order: Whenever a stop work order is issued by the Building Department, due to the failure of the work to meet the requirements of any ordinance of the Village, a reinstatement fee of fifty seven dollars fifty cents ($57.50) shall be paid to the Village Clerk prior to the lifting of the stop work order.
      5.   Percolation Test Fee: A fee of one hundred fifteen dollars ($115.00) shall be charged for each percolation test witnessed by the building officer or his representative.
   D.   Additional Fees:
 
Temporary occupancy fee
$115.00 plus a performance bond equal to 100 percent of the cost of completion of the exterior improvements as determined by the building officer or $5,000.00, whichever is greater
 
   E.   Refunds: Whenever, after application for a building permit but prior to any building site preparation and/or construction activity, the applicant requests that the application be withdrawn and permits issued (if any) be revoked, the village shall issue a refund of all building permit fees paid by the applicant, excepting, however:
      1.   Plan review fee(s).
      2.   An additional charge, when appropriate, to reimburse the village for time spent or costs incurred other than the plan review fee.
Upon withdrawal of a building permit, the applicant can obtain, at his cost, copies of any or all materials from the file so established by the building department, but the actual submissions themselves shall remain the property of the village. No refund shall be made once construction activities have commenced. (Ord. 2013-994, 7-11-2013)

8-1-6-2: DEPOSITS:
   A.   Cash Deposit Required: Before commencing any work for which a building permit is required, the person, builder, or developer applying for such building permit shall make a cash deposit with the village to ensure the completion of said work and to provide for the cost of repairing any damage to village property for which such building permit was issued. Such deposit shall be made in the following amounts for each building permit issued:

Except that upon a written request by a builder/developer and approval by the building officer, a builder or developer who intends to construct not less than twenty five (25) single-family homes on lots under single ownership in an approved subdivision may make a lump sum cash deposit of one hundred thousand dollars ($100,000.00) for all of the single-family building permits applied for by that builder or developer on lots under its ownership in said subdivision. Such builder or developer must also have a valid letter of credit for the public improvements required for said subdivision.
   B.   Payment, Retention: The cash deposit provided for herein must be paid as follows: Fifty percent (50%) to be paid by contractor doing the work and fifty percent (50%) to be paid by the owner. When no owner exists, as in the case of a spec house, the owner's portion shall be paid by the contractor. The contractor's portion of the cash deposit shall be held by the village treasurer until all construction and restoration work is completed to the satisfaction of both the village engineer and the building officer. The owner's portion of the cash deposit shall be held by the village treasurer until all landscaping and restoration work is completed to the satisfaction of both the village engineer and the building officer.
   C.   Return: Upon the written request from the applicant or contractor for the return of the cash deposit, and if no damage to village property resulting from the construction work or landscaping work has been determined upon inspection by the village engineer and/or building department, and if all inspections have been made and all requirements arising out of those inspections have been addressed to the satisfaction of the building department, and if all required documentation has been submitted to complete the job file for the subject project, the total amount of the deposit, without accrued interest, shall be returned to the contractor. A builder or developer, who has posted the lump sum cash deposit as provided in subsection A of this section, may request in writing the return of said deposit, and in lieu thereof, provide an individual cash deposit for each permit that has not been completed at the time of the request.
   D.   Retention; Additional Deposit: In the event that damage resulting from the construction work or landscaping work has been detected by the village engineer and/or the building department, any or all of the deposit necessary to effect repairs to village property shall be retained by the village and the balance (if any) returned to the contractor pursuant to subsection C of this section, but an applicant who continues to do work pursuant to the building permit and/or upon whose lot landscaping work remains to be completed shall make an additional deposit in an amount sufficient to meet the requirements of this section. Failure to make an additional deposit as required by this subsection, within ten (10) days after demand has been made by the village, shall result in the revocation of the applicant's building permit, and an immediate stop work order shall be issued.
   E.   Penalty: Any person violating any of the provisions of this section shall be subject to a fine of not less than twenty five dollars ($25.00), nor more than five hundred dollars ($500.00), for each offense, and a separate offense shall be deemed to have been committed for each day during which such violation occurs or continues.
