8-1-4-4: NONRESIDENTIAL BUILDINGS:
   A.   Code Adopted: The International Building Code, 2018 edition, including Appendix Chapters, as published by the International Code Council, three (3) copies of which are on file in the office of the Village Clerk of the Village of South Barrington, is hereby adopted and incorporated by reference as the Nonresidential Building Code of the Village of South Barrington, Illinois ("Nonresidential Building Code"), for the purpose of regulating and governing the construction, alteration, relocation, enlargement, replacement, repair, equipment, use and occupancy, location, maintenance removal and demolition of nonresidential buildings and those buildings not covered under the International Residential Code, with the additions, insertions, deletions and changes as set forth in subsection B of this section.
   B.   Additions, Insertions, Deletions and Changes to Nonresidential Building Code: The 2018 International Building Code is modified as set forth in a document entitled "Additions, Insertions, Deletions and Changes to 2018 International Building Code - Adopted December 2020," which document will be appended to the Nonresidential Building Code and on file in the office of the Village Clerk of the Village of South Barrington.
   C.   Fee Schedule: The fee for each plan examination and building permit for nonresidential buildings shall be paid in accordance with the following schedule:
      1.   Review fees for on-site improvements, which require the review by the village engineer for such items as water detention, drainage, waste treatment facilities, well, and other engineering items shall be billed at cost of the consulting village engineer plus ten percent (10%) for administrative handling.
      2.   Review fees for architectural, landscape, and building code items shall be as follows:

      3.   Permit fees shall be one percent (1%) of the first two hundred thousand dollars ($200,000.00) of estimated construction costs and one-half of one percent (0.5%) of estimated construction costs over the first two hundred thousand dollars ($200,000.00).
      4.   Estimated construction costs shall be determined using the following cost factors:

   For determination of building permit fees, the gross floor area of each type of space listed above shall be computed using the outside dimensions indicated on the blueprints as submitted by the applicant.
   Basic building permit fee shall be the sum of each product which applies from the above listing:

   Any review fees required by sections C shall be paid at time of application. The building officer shall estimate the review fees and collect them prior to any reviews. If the actual review costs differ from the estimate, the amount shall be adjusted at time of building permit issuance.
      5.   Additional Fees:
         a.   Temporary Occupancy Fee: $115.00 plus a performance bond equal to 100% of the cost of completion of the exterior improvements as determined by the building officer or $5,000.00, whichever is greater.
      6.   Violation Penalties: Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the building official, or of a permit or certificate issued under the provisions of this code, shall be guilty of a misdemeanor, punishable by a fine of not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00), or by imprisonment not exceeding thirty (30) days in an institution other than the penitentiary, or both such fine and imprisonment. Each day that a violation continues shall be deemed a separate offense.
      7.   Unlawful Continuance: Any person who shall continue any work in or about the structure after having been served with a stop work order, except such work as he is directed to perform to remove a violation or unsafe conditions, shall be liable to a fine of not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00).
   D.   To the extent the Nonresidential Building Code conflicts with other ordinances or parts of ordinances adopted by the Village of South Barrington, the more restrictive ordinance or part thereof shall govern.
