8-1-10: LAKES:
   A.   Permit And Compliance Required: It shall be unlawful to construct any lake anywhere within the Village without complying with the terms of this section, and without obtaining a permit therefor as herein provided.
   B.   Application For Permit: Applications for a permit shall be accompanied by a topographical map showing the shoreline and the depth of water proposed, test borings to show soil conditions indicating that the lake will retain water throughout the year, and a performance bond guaranteeing that the work will be completed in accordance with all Village ordinances.    C.   Fees:
      1.   Filing Fee And Engineering Review Fee: Any person applying for a permit for the installation of a lake or pond as required by this section shall pay, at the time of such application, a filing fee of twenty five dollars ($25.00) and an engineering review fee. The amount of the engineering review fee shall be determined by the Village official accepting the application for the permit and shall be equal in amount to the cost to the Village of the Village Engineer's review of the plans and specifications for the proposed lake or pond.
      2.   Permit Fee: Prior to the issuance of a permit for the installation of a lake or pond, the person having applied for such permit shall pay a permit fee in the amount of ten dollars ($10.00) for each surface acre or fraction thereof of the proposed lake or pond. The permit fee shall not become due, and the permit shall not be issued, until the application is approved by the President and Board of Trustees pursuant to this section.
      3.   Reimbursement To Village For Engineering And Inspection Fees: Any person having received a permit for the installation of a lake or pond is hereby required to reimburse the Village for engineering and inspection costs incurred by the Village for inspections of the proposed pond or lake. Such reimbursement shall be made within thirty (30) days after the permittee has received a bill for such engineering and inspection costs.
      4.   Penalties: Any person violating any of the provisions of this subsection C shall be fined not less than ten dollars ($10.00) nor more than five hundred dollars ($500.00) for each offense, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues.    D.   Issuance Of Permit: Permits for lakes shall be issued by the President and Board of Trustees.
   E.   Regulations And Restrictions On Construction Operations:
      1.   Dykes And Dams: Any dykes or dams shall be constructed in such a manner as to hold water safely.
      2.   Hours Of Construction: No trucks used for construction of a lake shall use Village roads, and no trucking operations shall be carried on after the hour of six o'clock (6:00) P.M. of any day or before the hour of seven o'clock (7:00) A.M. of any day.
      3.   Littering And Storage Of Materials Prohibited: No accumulation of litter or storage of materials shall be permitted on any premises in connection with the construction of a lake.
      4.   Location Of Lake: No lake shall be constructed in such a location or in such a manner as to create any danger of chemical pollution or biological pollution of the lake water.
      5.   Seeding Of Shoreline: The shoreline must be seeded upon completion of construction.
      6.   Time For Completion Of Work: All work shall be completed within one year of the issuance of the permit therefor.
   F.   Inspections: All construction of lakes shall be inspected before and during construction by a person designated by the President and Board of Trustees for the purpose. (Ord. 0-71-12, 3-11-1971)
   G.   Revocation Of Permit: In addition to the penalty hereinafter provided and in addition to any civil remedy available to the Village, the President and Board of Trustees may revoke any permit issued for the installation of a lake or pond upon the failure of the permittee to pay any of the fees herein provided and/or upon the failure of the permittee to conform to any applicable ordinance of the Village.
