709.01   PERMIT REQUIRED.
   (a)   No person shall commence any drilling operation for the exploration of gas or oil without first having obtained a drilling permit from the Village of Perry.
   (b)   For purposes of this chapter, any drilling operation which exceeds a penetration of greater than fifty feet from site-grade level shall be required to obtain a drilling permit.
   (c)   Each drilling site shall require a separate drilling permit.

709.02   LIABILITY BOND.
   As a condition precedent to the issuance of a drilling permit, an applicant shall file a liability bond in the amount of twenty-five thousand dollars ($25,000) which names the Village of Perry as the insured party and protects the Village of Perry against any and all property damage which results from the drilling operation, directly or indirectly, including but not limited to the entire construction phase, and includes but is not limited to the following:
   (a)   Damage to municipal roads, traffic control devices, municipal buildings, municipal equipment and any other municipal land or structures.
   (b)   Damage to municipal utility services.
   (c)   Extraordinary expenses incurred by the Village of Perry in regard to the use of safety forces at an emergency caused by the drilling operation.

709.03   APPLICATION FOR PERMIT.
   At least seven days prior to the commencement of any drilling operation, the driller shall file with the Perry Village Zoning Inspector, the Perry Township Fire Department and the Perry Village Police Department a plat, drawn to scale, which shows the following information:
   (a)   Ingress and egress points from public highways to the well site and brine pits.
   (b)   The well location.
   (c)   The location of all known wells, storage tanks, and/or separators, located within 1,000 feet.
   (d)   The location of all storage tanks.
   (e)   The location of all separators.
   (f)   The location of all power shut-offs and a detailed description necessary for the operation of such shut-offs.
   (g)   The location of any and all transmission lines.
   (h)   The location of oil flow shut-offs and a detailed description necessary for the operation of such shut-offs.
   (i)   The location of any access roads.
   (j)   A list of telephone numbers of the drillerbusiness and residence, and any other telephone numbers which can be used for emergency notification to the driller or his employees or agents.
