(a) Each well site shall have a brine pit which shall be used for the storage of underground or surface waste, natural or artificial brines or other oil field waters, or sewage used in the production, transportation or storage of oil and gas or condensate, which pit shall comply with applicable regulations of the State of Ohio, Division of Oil and Gas. In addition to the compliance to said regulations, the brine pit shall be lined with a plastic liner with a minimum thickness of six mils, and said liner shall be reinforced. The brine pit liner must be maintained with a water-tight integrity and must be nonleaking.
(b) Said brine pit liner must extend to a height in the side wall of at least two feet above the maximum allowable level of the brine in the pit.
(c) Upon the completion of the final pumping operations for the well, all brine, sludge, or other materials contained in the brine pit must be completely removed from the well site in accordance with regulations of the State of Ohio, Division of Oil and Gas, and in addition, the plastic liner previously referred to in this section, must be completely removed from the well site location.
(d) Any drilling permit holder, owner of a leasehold interest, or land owner who shall violate any of the terms or conditions of this section shall be subject to a fine upon conviction in the amount of one thousand dollars ($1,000). Each and every day during which such violation continues shall be deemed a separate offense. The Perry Village Zoning Inspector, the Perry Village Police Department and the Perry Township Fire Department shall be authorized to enter upon the well site location for purposes of inspecting the integrity of the brine pit liner or other compliance with this chapter and shall be authorized to issue citations for violations of this section in accordance with law.
