Appendix: Maximum penalty schedule
The state standards set forth in the document Minimum Design Construction Criteria for Subdivision Streets contained in 19 NCAC 02C.0200, are hereby adopted and shall be applicable to all streets developed outside of the city, but within the zoning jurisdiction and water-sewer service area. Standards for streets within the city shall be established on a street-by-street basis.

(A) It shall be unlawful for any person to obstruct any drainage ditch in the city.
(B) Construction of culverts shall comply with the specifications of the City Manager.

(C) The piping of ditches along ribbon paved streets is prohibited except for driveway access which shall be restricted to a minimum of 12 feet and a maximum of 16 feet on a single driveway and a double driveway shall be restricted to no more than a maximum of 24 feet.

(D) Punishment for a violation of this section shall be as set forth in § 1-99, except that the penalty shall be as is set out in the appendix attached hereto and made a part hereof. A copy of the penalty schedule, which may be amended from time to time, shall be kept on record in the office of the City Clerk.
(A) (1) No brick, stone, wood or other substance shall be placed or allowed to lie in any street or alley of the city. No person shall place or permit in or upon any sidewalk, street or alley any boxes, crates, barrels, casks, tools, provisions or other material, substance or merchandise whatsoever.
(2) Building material, earth and other obstructions of similar character may be allowed in the streets with the written permission under the restrictions as the City Manager may impose. No building material, earth and other obstructions shall take up or occupy more than one-half of the street at any one place.
(B) This section shall not apply to the receiving of merchandise on the sidewalks or to the opening of boxes or crates in which same may be shipped, however, the opening of the boxes or crates and the receiving of the merchandise shall be expedited as much as practicable.

It shall be unlawful for any person:
(A) To allow or permit any shrubbery, undergrowth, trees, weeds or any other form of plant growth to grow upon, protrude or project into or upon any sidewalk, street, alley or public square within the city; and
(B) To allow any shrubbery, undergrowth, trees, weeds or any other form of plant growth to stand upon any property, at or near any street intersection so that the same may obscure the view of pedestrians or persons traveling in vehicles at the street intersections.
