A zoning board of appeals is hereby authorized to be established. The board shall consist of a chair and six (6) members, and shall be appointed by the mayor, with the consent of the city council. The board shall elect from its members an acting chair to act whenever the chair is absent. When first appointed, the members of the zoning board of appeals shall serve respectively for the following terms: one for one year, one for two (2) years, one for three (3) years, one for four (4) years, one for five (5) years, one for six (6) years and one for seven (7) years, or until their respective successors have been duly appointed and qualified. The successor to each member so appointed shall serve for a term of five (5) years, or until his successor has been duly appointed and qualified. Vacancies upon the board shall be filled for the unexpired term of the member whose place has become vacant, in the manner herein provided for the appointment of such members. The city council may provide by resolution for the compensation of the members of the board of appeals. (Ord., 8-27-1974)
The zoning board of appeals is hereby vested with the following jurisdiction and authority and it shall be its duty:
A. To hear and decide appeals in which it is alleged there is an error in any order, requirement, decision, interpretation or determination (hereinafter referred to collectively as "decision") made by the zoning administrator, in the manner set forth in section 10-10-5 of this code.
B. To hear and decide on applications for variations from the regulations and restrictions imposed by the zoning title in the manner and subject to the standards set forth in title 10, chapter 11 of this code.
C. To hear and report to the corporate authorities on such other matters as may be referred thereto by said corporate authorities, subject to the provisions of the zoning title.
D. To hear and decide all other matters upon which it is authorized or required to pass under the zoning title or the applicable Illinois statute. (Ord., 8-27-1974)
