10-2-1: ADOPTION OF CODES:
There are hereby adopted for the village of Milan the following codes and their appendices:
   2021 International building code (IBC)
   2021 International existing building code (IEBC)
   2021 International residential code (IRC)
   2021 International property maintenance code (IPMC)
   2021 International energy conservation code (IECC)
   2021 International fire code (IFC)
   2021 International fuel gas code (IFGC)
   2021 International mechanical code (IMC)
   2021 International plumbing code (IPC)
   2021 International swimming pool and spa code (ISPSC)
   2020 National electrical code (NEC)
   2018 Illinois accessibility code (IAC)
   2014 Illinois plumbing code (ILPC)
   A.   Building Code: There is hereby adopted as a portion of the building regulations for the village, the building code, as adopted in this section, being a compilation of the rules and regulations prepared by the International Code Council for the regulation of building construction, grading and excavation, as amended and supplemented by 410 Illinois Compiled Statutes 25/1 through 25/8, 2002 edition, being an act of the Illinois legislature known as and called the "environmental barriers act". One copy of said building code, and one copy of the act of the Illinois legislature known as and called the "environmental barriers act" are on file in the office of the village clerk and are available for public use, inspection and examination.
   B.   Existing Building Code: There is hereby adopted as a portion of building regulations for the village the existing building code, as adopted in this section, being a compilation of the rules and regulations prepared by the International Code Council for the regulation of maintenance of existing buildings and premises, equipment and facilities; light, ventilation, space, heating, sanitation, life and fire safety hazards; responsibility of owners, operators and occupants and occupancy of existing premises and buildings. One copy of said existing building code, is on file in the office of the village clerk and is available for public use, inspection and examination.
   C.   Residential Code For One- And Two-Family Dwellings: There is hereby adopted as a portion of the building regulations for the village the residential code for one- and two-family dwellings, as adopted in this section, being a compilation of the rules and regulations prepared by the International Code Council for the regulation of construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, removal and demolition of detached one- and two-family dwellings and multiple single-family dwellings not more than three (3) stories in height with a separate means of egress and their accessory structures. One copy of said residential code for one- and two-family dwellings, is on file in the office of the village clerk and is available for public use, inspection, and examination.
   D.   Property Maintenance Code: There is hereby adopted as a portion of the building regulations for the village the property maintenance code, as adopted in this section, the provisions of which shall apply to all existing residential and nonresidential structures and all existing premises and constitute minimum requirements and standards for premises, structures, equipment and facilities for light, ventilation, space, heating, sanitation, protection from the elements, life safety, safety from fire and other hazards, and for safe and sanitary maintenance; the responsibility of owners, operators and occupants; the occupancy of existing structures and premises; and for administration, enforcement and penalties.    F.   Excavation Permits: The fee for each and every excavation permit issued by the building inspector under authority of this chapter shall be fifty-five dollars ($55.00) for the excavation in any street or alley. No refund shall be made of any excavation permit fee.
   G.   Inspections:
 
Inspections outside of normal business hours (minimum charge 2 hours)

Notes:
1.   Or the total hourly cost to the jurisdiction, whichever is the greatest. This cost shall include supervision, overhead, equipment, hourly wages and fringe benefits of the employees involved.
2.   Actual costs include administrative and overhead costs.
 
   H.   Swimming Pools: The fee for each and every swimming pool permit issued by the building inspector under authority of this chapter shall be twenty-five dollars ($25.00).
   I.   Storage Tanks: The fee for the permit authorizing the installation or removal of storage tanks issued by the building inspector under authority of this chapter shall be fifty five dollars ($55.00). (Ord. 1570, 9-17-2012; amd. Ord. 1776, 11-6-2023)
