703.01 DEFINITIONS.
(a) "Person" includes the singular and the plural and shall also include any person, firm, corporation, association, partnership, profit or nonprofit, society or any other organization whether acting together for a common purpose or otherwise.
(b) "Emergency Medical Technician-Basic" (EMT-B); "Emergency Medical Technician-Intermediate" (EMT-I); "Emergency Medical Technician-Paramedic" (EMT-P); "Emergency Medical Service" and "ambulance" are defined herein by reference to and in accordance with Ohio R.C. 4765.01, all of which are incorporated herein by reference.
(c) "Ohio Board of Pharmacy" means the licensing agency for controlled drugs in the State of Ohio.
(d) "Ohio Department of Public Safety" means the licensing agency in the State of Ohio for all EMT-B's, EMT-I’s and EMT-P's.
(e) "Ohio Emergency Medical Services Board" means the board created in conjunction with the Ohio Emergency Medical Services Agency which deals with matters concerning standards for EMS operators within the State.
(f) “Ohio Medial Transportation Board” means the licensing agency in the State of Ohio for private ambulance service organizations, private non-emergency medical service organizations and private air medical service organizations.
(g) "Vehicle" means the following:
(1) Basic life support (BLS) unit means any ambulance equipped and staffed with two attendants each having a minimum certification of EMT-B.
(2) Advanced life support (ALS) unit means an ambulance equipped and staffed with two attendants of which at least one shall be a certified paramedic and the other shall have a minimum certification of EMT-B, for any emergency in the field.
(3) Mobile intensive care (MIC) unit means an ambulance equipped and staffed with one registered nurse with a current ACLS provider certification and critical care experience, one paramedic and another person with minimum certification of EMT-B for providing intensive care and transport.
(h) "Rescue squad" means an ambulance-type vehicle operated by the Mansfield Fire Department personnel who, while primarily trained as firefighters, are additionally trained as EMT's for the purpose of providing prehospital emergency care and providing patient transport. A rescue squad vehicle, in addition to being equipped as either a BLS or ALS unit, is also equipped with extraction tools used to remove victims from traffic or industrial accidents. A rescue squad is minimally manned by two firefighters who are EMT-B or better qualified.

703.02 LICENSE REQUIRED.
No person or ambulance service shall furnish, conduct, operate, maintain, advertise as engaging in, propose or profess to engage in the business or service of providing EMS to persons who are sick, injured or otherwise incapacitated in the City for purposes of emergency, pre- hospital care unless that service first obtains a license as set forth in this chapter. Providers of non-emergency invalid/patient transport shall also comply with the licensing provisions set forth in this chapter.

703.03 APPLICATION FOR LICENSE; RENEWAL.
(a) Each initial application for a license shall be accompanied by a five hundred dollar ($500.00) fee and shall be made on forms prescribed by the Service-Safety Director, such forms to provide at least the following information:
(1) Name and address of the applicant and if the applicant is a corporation or a partnership, an identification of the majority ownership interest and/or the identification of any person owning more than ten percent (10%) of the ownership interest of such corporation or partnership.
(2) Any trade or other fictitious name under which the applicant does business or proposes to do business.
(3) A detailed chronological history of the applicant with regard to the provision of emergency medical services and the transportation of patients within the State.
(4) A description of each ambulance to be used including the make, model, year of manufacture, motor and chassis number, the license registration number in the State, the color scheme, insignia and monogram, or other distinctive characteristics to be used to designate the applicant's ambulance.
(5) A list of each EMT including level of training currently utilized by the service or intended to be utilized at any time in the future, and an affidavit that each such person has a current and valid license issued by the Ohio Department of Public Safety.
(6) A list of each essential item of equipment including the communications and frequencies in each ambulance and each base station.
(7) The location and description of the place or places from which the ambulances are intended to be dispatched.
(8) The medical advisor of the EMS.
(9) A copy of the current Ohio Medical Transportation Board license and inspection report for each ambulance operating in the City of Mansfield.
(10) Any other information that the Service-Safety Director may deem reasonably necessary to a determination of compliance with this chapter.
(b) Any renewal of a license issued pursuant to this Chapter shall be accompanied by a one hundred fifty dollar ($150.00) fee and a copy of the current Ohio Medical Transportation Board license and inspection report for each ambulance operating in the City of Mansfield.

703.04 LICENSE ISSUANCE; EXPIRATION; TRANSFER.
(a) Within fourteen days after receiving a completed application for a license, the Service-Safety Director shall conduct any and all inspections investigations or otherwise, that in their sole discretion, they may deem appropriate.
(b) Within seven days after receipt of inspection results, the Service-Safety Director shall deny or approve issuance of a license.
(c) A license shall be valid only for the provider to whom issued and so long as such provider is in compliance with all requirements and regulations under this chapter.
(d) Any change of ownership of a license shall terminate the license and shall require a new application, a new license and conformance with all the requirements of this chapter, as upon original licensing. The Service-Safety Director shall be notified immediately of any sale, assignment or other transfer of any vehicle's being used in the City by a licensee and at such time the vehicle's conformance with all applicable licensing requirements shall be verified.
(e) Each licensee's vehicles, its equipment and the premises designated in the application, and all records relating to its maintenance and operation as such, shall be open to inspection at any time by the designated representatives of the Service-Safety Director.
(f) Either the licensee or the Service-Safety Director may cancel the license upon sixty days written notice.

703.05 COMPLIANCE STANDARDS FOR LICENSEE.
Each licensee shall at all times comply with the following:
(a) The standards, requirements and regulations provided for by this chapter and the Ohio Medical Transportation Board.
(b) All applicable laws and ordinances relating to the provisions of emergency medical services or which control the treatment of persons suffering sudden illness, injury or being subject to communicable diseases (not applicable to non-emergency transport licensees). (Ord. 12-103. Passed 6-5-12.)
703.06 NONCOMPLIANCE/SUSPENSION/REVOCATION/NON-RENEWAL OF LICENSE.
(a) If the Service-Safety Director determines that the emergency medical service licensee does not continue to meet each standard specified and any rules adopted thereafter, the Service-Safety Director shall give written notice to the licensee of any deficiencies and shall require correction of those deficiencies within thirty days of such notification. Should the Service- Safety Director determine that such deficiencies may affect the health and safety of person or their property, the period to correct deficiencies may be appropriately shortened. If the Service-Safety Director determines that the deficiencies remain uncorrected after the notification/correction period, the Service-Safety Director may suspend, revoke or non-renew the license. The licensee under suspension may request authority to continue to operate the emergency medical service until its administrative appeals have been exhausted. Such request must be filed within five days of service of the suspension notice. During any such license suspension, the Service-Safety Director may undertake any reasonable activity to ensure the availability of EMS services in the City.
(b) Any suspension, revocation or non-renewal of a license under this section may be appealed to the Service-Safety Director. Notice of such appeal shall be in writing and shall be filed with the Director within five days after the order of suspension, revocation or non-renewal. The Director shall within five days thereafter proceed with the hearing of such appeal and shall approve, modify, or annul such order. All parties interested shall be afforded the opportunity to be heard and may be represented by counsel.
(c) Upon suspension, authority to continue operations not having been granted, revocation or non-renewal of a license, operations shall cease and no person shall permit any continuing operation with such licensee's equipment.
(d) Renewal of any license hereunder, upon expiration for any reason or after revocation, shall require conformance with all requirements of original licensing for the license involved. (Ord. 12-103. Passed 6-5-12.)
