(A) Any fire company under contract to the city that willfully refuses to respond to an alarm to which it is summoned, or otherwise refuses to follow commands of the Fire Chief or command staff or directives of the Board Of Public Works and Safety, may be subject to withholding of appropriations by the city or other sanctions.
(B) If, in the opinion of the Fire Chief, a fire company has refused to respond or has otherwise willfully withheld its services, the Fire Chief shall refer the matter to the Board of Public Works and Safety, which may hold a hearing on the matter to determine whether or not withholding of appropriations or other action is in order. If the Board of Public Works and Safety finds that withholding of appropriations is in order, it may withhold any amount up to $1,000 for each offense, or impose other sanctions that may be deemed appropriate.
(C) Any fire company officer or firefighter who refuses to follow the commands of the Fire Chief, command staff, incident commander or other person in responsible charge of an incident shall be subject to immediate discipline, including, but not limited to, removal from the incident scene. Further, if, in the judgment of the Fire Chief, the behavior warrants, the matter may be reported to the Board of Public Works and Safety, which may conduct a hearing on the matter and may limit or exclude the officer’s or member’s continued participation at emergency incidents to which the officer’s or member’s fire company is summoned.
