Sec. 22.648. Responsibility to Provide Information Technology Services.
 
   (a)   The Department shall have the power and duty to supervise, control, manage, design, develop and administer all of the Information Technology Systems which may be developed and which are used by the offices and departments of the City of Los Angeles under the budgetary jurisdiction of the Council in accordance with rules and regulations established therefor by the Mayor and Council so as to provide optimum utilization of equipment, devices and systems consonant with sound economic, managerial and systems design practices.
 
   (b)   The Department shall, on behalf of the City:
 
   (1)   Develop and coordinate municipal uses of Information Technology Systems for public and city government information dissemination and other applications, and coordinate all technical matters involving usage of Information Technology Systems for both public and City government purposes;
 
   (2)   Monitor and report to the Mayor and to the City Council all legislative and industry matters impacting the City’s Information Technology policies, programs and applications consistent with the provisions of The Organization and Procedures Manual on Legislative Matters Affecting the City of Los Angeles.
 
   (3)   Assume authority for all design, planning and coordination of other City Information Technology Systems as specified in Article 1 of this chapter, and developing and coordinating joint applications with the private sector and with other governmental entities;
 
   (4)   Coordinate the development of a strategic planning approach to Information Technology System uses for voice, data and video transmissions, processing and services which may be implemented by or through the cooperation of other City departments.

Sec. 22.649. Centralization of Services.
 
   In order to provide for the optimum utilization of Information Technology Systems for the departments and offices of the City of Los Angeles, it is hereby declared to be the policy of the Council that, insofar as such may be accomplished without conflicting with the powers and duties reposed in said offices and departments and, insofar as is practicable, all design, management, coordination and functional standardization for interoperability of Information Technology Systems shall be under centralized control and management of the General Manager of the Department as herein provided.

Sec. 22.650. Information Technology Projects Program.
 
   The General Manager of the Department shall, in the budgetary process, recommend to the Mayor and Council an annual Information Technology Projects Program indicating, by priority, those projects to be included in the work program for the Department.

Sec. 22.651. Control over Information.
 
   Each department or office of the City of Los Angeles utilizing any service employing the information technology equipment covered by this chapter shall have such control over the information supplied to and received from such equipment as each such department or office finds necessary to conduct its own affairs.

Sec. 22.652. Confidential Information.
 
   (a)   The General Manager of any department having control of any information to be processed by the Department which the respective General Manager determines is confidential, shall notify the General Manager of the Department in writing of the existence and confidential nature of such information, and shall specify with particularity the information which is to be treated as confidential.
 
   (b)   The General Manager of the Department shall consider the confidential nature of such information and shall take such measures as are required to maintain the security of such information. During the period of time such information is under the control of the Department, it shall have sole responsibility for the maintenance of the security of such information.
 
   (c)   It shall be a misdemeanor for any person to disclose or make known in any manner, except to a duly authorized representative of the department supplying such information, the content or nature of any such confidential information while it is in the custody of the Department for processing, or any such information which is originated by the Department, without the express consent of the General Manager of the department supplying the information, or to tamper with, change, alter or destroy any such information while it is in the custody of the Department, except in accordance with programs for processing the information which have been approved by the General Manager of the Department.

Sec. 22.653. Responsibility to Provide Communications Services.
 
   (a)   The Department shall be responsible for providing all communications services to the departments and offices of the City of Los Angeles. The Department shall provide, either by facilities owned by the City, or by contract, or shall otherwise procure from others, all communications services needed to discharge its responsibilities.
 
   (b)   The services, facilities, and equipment shall be provided or approved by the Department and shall be limited by the authority or funds which have been provided by the Council, or to that furnished by the requesting department to the Department for such services, facilities, and equipment.

Sec. 22.654. Nature of Services.
 
   The provision of communications services shall include, but not be limited to, the design, planning, specification, leasing, purchasing, distribution, disposition, installation and maintenance of all communications equipment or services necessary therefor and may include operation of equipment and facilities used to provide such services. It shall also include the examination and approval of plans for:
 
   (a)   The construction of new public buildings and the remodeling of existing public facilities or leased facilities for City use; and
 
   (b)   Recommendations as to panel boards, conduit raceways, allocation of space and other design requirements important to the proper communications requirements, present and future, of the proposed structure or remodeling project.
