The City hereby approves and adopts the Uniform Rules, Regulations and Standards for the Design and Construction of Sewerage Improvements as formulated by the Committee on Uniform Standards dated May 11, 1978, a copy of which Standards is attached to original Ordinance 78-78 as Exhibit "A" and incorporated herein as though fully rewritten.
(Ord. 78-78. Passed 10-2-78.)
Excepting duly authorized municipal employees, no owner of property or other person shall make any connection with local or main sanitary or storm sewers, nor shall any person make an opening or excavation in any street or in any other public way or property in the City, without first having obtained a permit therefor from the Director of Public Works.
(Ord. 1053. Passed 8-24-14; Ord. 1058. Passed 8-24-14.)
Before any permit for any such connection, opening or excavation is issued, the owner or other person applying therefor shall pay a permit fee of three dollars ($3.00) for the purpose of covering the cost of issuance of permits, of preservation of necessary records and of inspection. However, such permit fees shall not apply to a public utility which has deposited the sum of three hundred dollars ($300.00) with the Director of Finance to secure the cost and expense of placing any such street, public way or property in a condition as good as existed prior to the making of any such opening or excavation, which deposit is hereby authorized.
(Ord. 1053. Passed 8-24-14; Ord. 1058. Passed 8-24-14.)
In addition to the permit fee and before any such permit is issued, each person, except a public utility which has made the deposit as provided in Section 901.13, shall deposit with the City such sum of money as may be deemed sufficient by the Director of Public Works to cover the cost and expense of placing any street or other public way or property in which an opening or excavation is to be made in a condition as good as existed prior to the making of such opening or excavation. All repairs and replacements of such openings or excavations shall be performed either by the City or in accordance with the requirements of the Director of Public Works. All sewer connections shall be made in accordance with the requirements of the Director of Public Works. All connections, openings or excavations and the replacement or repair thereof shall be subject to such inspection as may be ordered by the Director of Public Works.
(Ord. 1053. Passed 8-24-14; Ord. 1058. Passed 8-24-14.)
Each such permit shall state the name and address of the owner or other person applying therefor and the location where, and the purpose for which, such connection, opening or excavation is to be made. In addition, it shall contain the provision with respect to holding harmless and indemnification of the City as hereinafter provided. Each such permit shall be accepted in writing by the person to whom issued, except that public utilities which elect to make the deposit as hereinbefore provided shall accept such nonliability and indemnification provision as a part of and as a condition for such deposit.
(Ord. 1053. Passed 8-24-1914; Ord. 1058. Passed 8-24-1914.)
Each person shall, by the acceptance of any such permit, and public utilities making the deposit hereinbefore provided, thereby agree to hold harmless and indemnify the City from any and all lawful claims and demands whatsoever, for injuries to persons or property, and for all costs and expense to which the City may be subject or for which it may be liable in any proceedings at law or in equity or otherwise growing out of the making of any such sewer connection or any such opening or excavation, or by reason of failure to comply with any of the conditions hereof or of any such permit issued in compliance herewith.
(Ord. 1053. Passed 8-24-1914; Ord. 1058. Passed 8-24-1914.)
All basement, roof and other similar drainage for water outlets shall be connected with the storm sewer, and all sewerage drainage outlets shall be connected with the sanitary sewer. All materials used in such connections and in the repair and replacement of openings or excavations shall be satisfactory to the Director of Public Works. Barriers and, during the night season, lights shall be placed at and around any opening or excavation sufficient to notify and protect the public with respect thereto.
(Ord. 1053. Passed 8-24-1914; Ord. 1058. Passed 8-24-1914.)
