(a) The Director of Finance is hereby authorized and directed to establish water rates charged monthly by the Division of Utility Billing as follows:
(1) Effective January 1, 2024, the first 2,500 ccf of water used during each one month billing period shall cost $8.93 per 100 cubic feet of water and all over 2,500 ccf per month shall cost $4.46 per 100 cubic feet of water.
(2) Effective January 1, 2025, the first 2,500 ccf of water used during each one month billing period shall cost $9.29 per 100 cubic feet of water and all over 2,500 ccf per month shall cost $4.64 per 100 cubic feet of water.
(3) Effective January 1, 2026, the first 2,500 ccf of water used during each one month billing period shall cost $9.66 per 100 cubic feet of water and all over 2,500 ccf per month shall cost $4.83 per 100 cubic feet of water.
(4) Effective January 1, 2027, the first 2,500 ccf of water used during each one month billing period shall cost $10.05 per 100 cubic feet of water and all over 2,500 ccf per month shall cost $5.02 per 100 cubic feet of water.
(5) Effective January 1, 2028, the first 2,500 ccf of water used during each one month billing period shall cost $10.45 per 100 cubic feet of water and all over 2,500 ccf per month shall cost $5.22 per 100 cubic feet of water.
(b) In case of failure to pay any charges duly prescribed, the City may take any appropriate action against a recipient of water service or property owner, including but not limited to instituting any proceeding in a court of proper jurisdiction, shutting off service in accordance with Section 902.09 and certifying the amount of all unpaid water service charges to the Cuyahoga County Auditor, with interest accruing at a rate of ten percent (10%) per annum from thirty days after the date of delinquency, against the lot or parcel of land involved. Such assessments shall be so certified to the County Auditor and shall be collected and reimbursed to the City in the same manner as special assessments.

There is hereby established a special homestead exemption whereby water rates charged to a dwelling unit owned and occupied by a person 65 years of age or older or owned and occupied by a permanently or totally disabled person, provided that the sum of all income of all adults occupying the dwelling unit falls below $35,000 per annum. Pursuant to this exemption, persons eligible shall be charged 55% of the water rate established pursuant to this chapter. For the purposes of this section, “income” shall have the same meaning as in Section 128.03101.
