§ 31.145 POSITION CREATED; APPOINTMENT.
   There is hereby created the position to be known as Department Head for Parks and Cemeteries. The Department Head shall be in charge of the Parks and Cemeteries Department, and shall be appointed by the City Manager. This position may be filled by the head of another department or by another officer of the city. The Department Head for Parks and Cemeteries is vested with police power.

§ 31.146 OATH; BOND; COMPENSATION.
   Before entering upon the duties of his office, the Department Head for Parks and Cemeteries shall take the oath prescribed by law for all city officers, and shall execute and deliver a bond payable to the city in the penal sum of $1,000, surety and its cost to be approved and paid for by the city, conditioned upon the faithful performance of the duties of his office. As authorized by the Council's annual budget resolution, his salary will be set by the City Manager..

§ 31.147 DUTIES.
   (A)   He shall perform such duties as are provided for by law or ordinance, and in addition thereto such other duties as from time to time may be imposed upon him by the City Manager. In general, he will:
      (1)   Be responsible for the operation, administration, maintenance, and supervision of the city's cemeteries, parks, campgrounds and recreation areas.
      (2)   Be responsible for the proper control of grass, weeds and trees, and in general, for the good appearance of all city-owned or controlled land.
   (B)   Exceptions are grounds maintained by the Fire Department, grounds inside the work area of other departments, and grounds associated with storm water drainage ditches maintained by the Public Works Department.
   (C)   This responsibility includes lots whose owners have failed to comply with the requirements of the city code, and where the city takes the responsibility to abate a nuisance. In the event the city is abating a nuisance on property not owned by the city, the Department Head for Parks and Cemeteries will maintain an accounting of manpower and equipment so that the property owner can be charged for the cost of abating the nuisance.
   (D)   The Department Head for Parks and Cemeteries shall also prepare the annual departmental budget.

§ 31.148 EMPLOYEES.
   In executing his duties, the department head will be assisted by a cemetery sexton, a working foreman, and such other employees that are authorized by the City Manager, based on the manpower authorization and budget approved by the City Council. The cemetery sexton and working foreman may, if authorized by the City Manager, be the same person.

CEMETERY SEXTON
§ 31.160 POSITION CREATED; APPOINTMENT.
   There hereby is created the position of Cemetery Sexton, who shall be appointed by the City Manager upon the recommendation of the Department Head for Parks and Cemeteries.

§ 31.161 GENERAL DUTIES; ASSIGNMENT.
   He shall be under the supervision and control of the Department Head for Parks and Cemeteries, and shall perform such duties as are imposed upon him by law or ordinance, and in addition thereto such other duties as from time to time he may be directed to perform by the Department Head.

§ 31.162 BOND; OATH.
   Before entering upon the duties of his office, he shall take the oath prescribed for all city officers. A bond is not required as the Sexton is not authorized to take payments for services rendered at city cemeteries. All funds associated with the cemetery will be processed through the office of the City Clerk.
