§ 31.164 DUTIES AND AUTHORITY.
   The Sexton shall do, among other duties prescribed by the Department Head from time to time, the following:
   (A)   He shall take charge of the city cemeteries and shall keep the grounds, walks, and avenues of the same in good order and condition, and free from obstructions.
   (B)   He shall enforce all ordinances and regulations of the city respecting the cemetery, report violations of the same to the proper officers for prosecution, and may arrest any person found hunting, discharging firearms, or doing any unlawful act therein.
   (C)   He shall prevent the burial of any body in an unsold lot, or the lot of any private individual without his consent; and he shall superintend all burials in the commons, and specify their manner and place, and by night keep the gates of the cemetery closed and locked, and he shall see that all soldiers' and sailors' graves in the cemeteries are properly kept and cared for.
   (D)   In an unusual situation, the Sexton may authorize the performance of services and land transfers without prepayment of the fees required by the code, but only with a written and signed document from the receiver of such services or land promising to pay for the services or land within five working days after the service is performed or land is received.
