ADOPTING ORDINANCES
ORDINANCE NO. 3048
AN ORDINANCE ENACTING AND ADOPTING A SUPPLEMENT TO THE CODE OF ORDINANCES OF THE CITY OF KEWANEE AND DECLARING THAT THIS ORDINANCE SHALL BE EFFECTIVE IMMEDIATELY.
WHEREAS, The American Legal Publishing Corporation of Cincinnati, Ohio has completed the fifth supplement to the City Code of the City of Kewanee, which supplement contains all ordinances of a general nature enacted since the prior supplement to the City Code; and
WHEREAS, The American Legal Publishing Corporation of Cincinnati, Ohio has recommended the revision or addition of certain sections of the City Code which are based on or make references to sections of the State of Illinois Statutes; and
WHEREAS, It is the intent of the City Council to accept these updated sections per the changes of the law of the State of Illinois;
NOW THEREFORE BE IT ORDAINED, BY THE COUNCIL OF THE CITY OF KEWANEE THAT:
Section 1. The fifth supplement to the City Code of the City of Kewanee, Illinois as submitted by the American Legal Publishing Corporation of Cincinnati, Ohio, and as attached hereto, be and the same is hereby adopted by reference as if set out in its entirety. Changes to this fifth supplement are contained in Section 2 of this ordinance. A summary of the changes made due to the State of Illinois Statutes are:

§ 74.05 | Had new disabled street crossing language added. |
§ 74.12 | Railroad crossing language added. |
§ 134.01 | Language about breast feeding in public added. |
§ 136.01 | Had an EPA section number change. |
§ 137.04 | Added "knowingly or intentionally" to section about defacing firearms. |
Section 2. The following changes are made to the City Code as updated by the fifth supplement to the City Code of the City of Kewanee, Illinois as submitted by the American Legal Publishing Corporation.
a. Article 70.99(A) is changed to read:
§ 70.99(A) Traffic violations. Whoever violates any provision of this traffic code for which another penalty is not already otherwise provided, shall, upon conviction, be subject to a fine of not more than $500 as specified in § 10.99 "General Penalty" of this code."
b. Article 72.12(C), penalty for unauthorized use of parking spaces reserved for disabled persons, is changed to read:
§ 72.12(C) Any person found guilty of violating the provisions of this section shall be fined as set forth in § 72.99 $100.00, in addition to any costs or charges connected with the removal or storage of any motor vehicle authorized under this section."
c. Article 72.99 PENALTY is repealed.
d. The following paragraph is added to § 134.01 PUBLIC INDECENCY.
§ 134.01(C) Any person who exposes their private parts in a public place commits a public indecency. This includes urinating or defecating in public.
e. Article 95.10 DUMPING OR DEPOSITING OF LITTER PROHIBITED; EXEMPTIONS has the following subparagraph added:
§ 95.10(E) The person is acting pursuant to a special cleanup day established by the City."
Section 3 This Ordinance shall be in full force and effect immediately upon its passage and approval as provided by law.
