   943.01 GENERAL PROVISIONS.
   (a)   Applicant's Agreement. All applicants for service by the Electric Department of the City (in this chapter, Utility) shall complete the Utility's then standard application form and shall conform with and agree to the provisions set forth in the Codified Ordinances and the Utility's General Rules and Regulations as amended and revised from time to time.
   (b)   Summer/Winter Period. The summer period shall be the period represented by bills for five consecutive monthly billing periods beginning with the first monthly reading or estimate after May 14. The winter period shall be the period represented by bills for all other meter readings and estimates.

   (c)   Application Order for Riders. Rider A, Rider B, Rider D, Rider E, Rider F and Rider C are applied cumulatively and in the order listed.

   (d)   Temporary, Seasonal, or Unusual Service. Such service shall be provided under the Nonresidential Service Rate Schedule "NRS" under a special agreement. The special agreement shall require payment by the consumer of all facilities and costs involved, the terms under which such service will be provided, and any increases in the minimum charge, waiver of the minimum billing demand or billing at the non-demand metered rate as deemed appropriate by the Director of Electric for the circumstances under which such service will be provided.

   943.02 ELECTRIC SERVICE CURTAILMENT.
   In the event an emergency condition exists in the Utility, whether physical, economical or otherwise, beyond the control of the Utility to immediately remedy and because of which the Utility cannot satisfy the full electric requirements of its consumers, then it shall be necessary for the Director of Electric or his designee, upon authorization of the City Manager or his designee to:
   (a)    Request all consumers to voluntarily curtail their electric usage, if time permits, or
   (b)    Implement mandatory curtailment, reduction or interruption of electric service if the voluntary option set forth in paragraph (a) above is inadequate to reduce system demand to a level determined by said Director or his designee to be safe or appropriate. This may include physical disconnection from the City's electric distribution system for any consumer that fails to comply with a curtailment request.
   The Director of Electric shall promulgate such rules and procedures as he deems necessary to implement the electric curtailment process as authorized and set forth herein.

   943.03 PRIMARY UNDERGROUND ELECTRIC SERVICE.
    (a)    Conversion of Primary Overhead Electric Service to Primary Underground Electric Service. The procedure for converting existing primary overhead electric service to primary underground electric service is as follows:
      (1)    All concerned property owners shall petition the Utility to investigate the cost of converting the affected overhead facilities to underground.
      (2)    Utility shall prepare a cost estimate (actual cost not to exceed basis) for conversion from overhead to underground distribution facilities. The estimate shall include all costs of labor (construction and removal), materials, easements and rights of way, administrative burden (overheads), and applicable salvage. Total estimated cost shall be apportioned among affected property owners.
      (3)    Any conversion area shall require one hundred percent (100%) financial participation by property owners prior to the initiation of such project including provision of any necessary easements.
   (b)    Installation of Primary Underground Electric Service in New Subdivisions. The electric distribution system for all new subdivisions constructed in the City shall be installed underground.
   The requirements for primary underground electric service for a new subdivision are as follows:
      (1)   Subdivision developer shall provide the Utility with appropriate easements for installation of electric facilities to include cable, conduit, transformers, switches, street lighting, etc.
      (2)    Subdivision developer shall provide (trench, conduit installation, backfill, and surface restoration) a conduit path, installed to the Utility's specifications, along all routes required by Utility for provision of service to consumers. Details (size, number, materials, routing) of the primary conduit path shall be specified by the Utility. Conduits shall be encased in concrete when located under street pavement. Conduit system shall become the property of the Utility upon acceptance for use.
      (3)    The Utility shall provide, install and own all primary cable, appropriate pad-mounted transformers, switching and junction equipment, etc.
      (4)    Consumer shall provide, install, and own all secondary service conductors to the Utility's designated point of service. The Utility shall connect consumer's secondary service conductors to its equipment after receipt of all necessary approvals.
