943.065 HIGH LOAD FACTOR INDUSTRIAL SERVICE RATE SCHEDULE "HLFIS"
   (a)   Availability. This schedule is available to customers throughout the service area of the City of Hamilton Electric Distribution System where facilities of adequate capacity exist adjacent to the premises to be served.
   (b)   Applicability. This schedule is applicable to electric service for Commercial, Industrial and Governmental customers served through one meter at a single point of delivery with average monthly demand for the preceding twelve (12) months of 1,000 kW or greater and whose average monthly load factor is seventy-five percent (75%) or greater for the prior calendar year. For new service, a customer will be given three (3) months to reach a monthly load factor of seventy-five percent (75%) or greater. If a customer does not meet the seventy-five percent (75%) load factor requirement after three (3) months, the City reserves the right to move the customer to the standard Industrial Service rate schedule. Service under this schedule is not applicable to seasonal, standby, auxiliary or supplementary service or for resale service.
   (c)   Character of Service. Service furnished under this schedule shall be three-phase, 60 Hertz alternating current at available City secondary or primary voltages supplied through a single set of service wires.
   (d)   Monthly Rates and Charges.

   (e)   Determination of Billing Demand. The monthly demand charge shall be the greater of the metered demand adjusted for power factor, the minimum billing demand or the adjusted demand.
      (1)   Power Factor. Power factor shall be not less than ninety percent (90%) lagging. If the Utility determines consumer's power factor to be less than ninety percent (90%), the monthly billed demand shall be the number of kilowatts (kW) equal to the metered kilovolt-amperes (kVA) multiplied by 0.90.
      (2)   Minimum Billed Demand. The minimum billed demand shall be seventy percent (70%) of the greater of: (i) the customer's contract capacity, or (ii) the customer's highest monthly billed demand, during the preceding twelve (12) months.
   (f)   Definitions. The following definitions apply to interruptible customers receiving service under this schedule:
      (1)   "Annual Load Factor" shall mean the annual metered kilowatt-hours ("kWh") divided by the hours in the year divided by the annual peak metered kilowatts ("kW").
      (2)   "Monthly Load Factor" shall mean the monthly metered kilowatt-hours ("kWh") divided by the hours in the billing period divided by the monthly peak metered kilowatts ("kW").
      (3)   "Interruptible" shall mean a customer that is willing and able to reduce its demand and energy use by at least 97% when given a Curtailment Notice.
      (4)   "Curtailment Notice" shall mean a notice, given in writing or by email, from the City to the customer, setting forth a projected Peak Demand Period. A Curtailment Notice must be given at least twenty-four (24) hours in advance of the beginning of each Peak Demand Period.
      (5)   "Peak Demand Periods" shall mean a period of time projected by the electric utility staff during which the electric demand through the City is expected to be greater than normal and during which the City requires the customer to reduce ninety-seven percent (97%) of electric demand. Peak Demand Periods typically occur between 1:00 p.m. and 7:00 p.m. local time, and typically occur twenty-five (25) to thirty (30) times annually during the months of May through September, although the City specifically reserves the right to project a Peak Demand Period at any time throughout the year and more than thirty (30) times if needed.
      (6)   "Failure to Curtail" shall mean the customer did not reduce its electric demand and energy ninety-seven percent (97%) when given adequate notice as defined in "Curtailment Notice". In the event of a Failure to Curtail, customer will be responsible for up to $10.00 per kW for all uncurtailed kW demand for up to twelve (12) months based on the City's increased capacity and transmission costs caused by the customer's Failure to Curtail.
 
   (g)   Rate Adjustment. The Monthly Rates and Charges included in this rate schedule, including the Minimum Monthly charge, are applicable to the amount or amounts, if any, determined under the following riders and taxes:
      (1)   Rider A - Power Cost Adjustment Rider (PCA).
      (2)   Rider B - Electric Rate Stabilization Fund Adjustment Rider (ERSF).
      (3)   Rider C - Suburban Surcharge Rider
      (4)   Rider D - Unfunded Environmental Mandates Adjustment Rider (UEMA).
      (5)   Rider E - Unfunded Governmental and Regulatory Mandates Electric Utility Adjustment Rider (UGRMA).
      (6)   Rider F - Economic Development Cost Electric Utility Adjustment Rider (EDCA)
      (7)   Excise (Kilowatt-Hour) Tax.
   (h)   Other Terms and Conditions.
      (1)   The charges for service under this rate schedule exclude and are in addition to charges for service rendered to the customer under any other rate schedule.
      (2)   Service under the rate schedule is subject to all applicable provisions of the Codified Ordinances of the City of Hamilton and the Utility's General Rules and Regulations.
      (3)   The Utility reserves the right to require the consumer to install, own and operate at its expense, the necessary complete substation required to utilize service at the Utility's specified untransformed distribution voltage. In such case, a transformer ownership discount of $0.20 per kW of billing demand would apply.
      (4)   The Utility reserves the right to meter at either primary or secondary voltage by means of standard metering equipment. If the Utility elects to meter uncompensated at the secondary voltage, the billing kW, kVA and kWh shall be the metered kW, kVA and kWh multiplied by 1.01.
   (i)   Terms of Payment. All bills shall be due monthly and payable when issued. The account shall be considered delinquent if not paid in full by the due date appearing on the bill.
   (j)   Late Fee. As set forth in Chapter 927 of the Codified Ordinances of the City of Hamilton, a five percent (5%) late fee will be applied to the total amount due for payments received after the due date. An additional one percent (1%) late fee will be applied on outstanding balances over thirty (30) days in arrears.
   (k)   Effective Date. Effective for all billings issued for meter readings on and after April 1, 2024, and thereafter. (Ord. 2024-3-18. Passed 3-27-24.)
