943.17 EXCISE (KILOWATT-HOUR) TAX ADJUSTMENT.
   (a)   The rates and charges set forth in all applicable sections of the Codified Ordinances of the City of Hamilton, Ohio for the provision of Electric Utility Service to a customer within the corporate limits of the municipality shall include an amount equal to the excise (kilowatt-hour) tax imposed upon the City’s electric system by virtue of Ohio Revised Code Section 5727.81. Said amount shall be included and calculated with all in-city electric utility customer billing accounts having meter readings that include January 8, 2009, as part of the usage period, and shall be automatically adjusted to reflect any change in the kilowatt-hour tax imposed by Ohio R.C. 5727.81.
 
   (b)   Two-thirds of the credit which offset the amount of the kilowatt-hour tax for Electric System Customers within the municipal boundaries as legislated pursuant to Emergency Ordinance No. EOR2001-4-36, adopted April 25, 2001, is hereby repealed as to all in City electric utility customer billing accounts having meter readings that include January 8, 2009 as part of the usage period.

   (c)   The equal credit which offset the amount of the kilowatt-hour tax for Electric System Customers within the municipal boundaries as legislated pursuant to Emergency Ordinance No. EOR2008-11-122, adopted November 19, 2009, be and is hereby repealed as to all in-city electric utility customer billing accounts, effective immediately.
