§ 50.36  BASIS OF UTILITY RATES.
   The utility's rates are predicated upon the supply of service being rendered separately for each premises and for the ultimate usage in or on the premises.  The combining of service through one meter, of two or more separate classifications, or of two or more premises, or of two or more separate living quarters of the same premises will not be permitted except as specifically provided for under these rules and regulations, or supplements thereto, which are filed by the utility and approved by the Public Service Commission of Indiana.  An outlying or adjacent building of the customer, if located on the same premises, may be served from the supply to the main building.  PREMISES, as herein used, shall mean the main residence or living quarters for the use of a single-family or main building of a commercial customer, and shall include the outlying or adjacent buildings used by the same, provided the use of service in the outlying buildings is supplemental and similar to the service used in the main residence or building.

§ 50.37  DELINQUENT BILLS; COLLECTION CHARGE, DISCONTINUANCE OF SERVICE.
   (A)   Bills shall be due and payable at the office of the utility on the first business day of each month.  If paid by the fifteenth day of the month, the net shall be the amount to be paid.  If not paid by the fifteenth of the month in which due, a collection charge of 4% of the total current unpaid balance shall be added to the net bill.
   (B)   When the fifteenth day of the month falls on Sunday or on any legal holiday, the first business day thereafter shall be considered as the last day to pay the net bill.

   (C)   Where bills for service have not been paid by the twenty- fifth day of the month in which they are due, service shall be discontinued and the reconnection charge established in § 50.43 shall be paid before service is re-established.

§ 50.38  CUSTOMER WANTS SERVICE DISCONTINUED.
   Whenever a customer desires discontinuance of service, he shall notify the utility at its local office of this desire and of the date on which service is to be discontinued, sufficiently in advance of the date to provide a reasonable time for the utility to obtain a final meter-reading.  This section shall not apply to any case where a customer has entered into a contract with the utility to take service from the utility for a definite period of time specified or provided in the contract.

§ 50.39  FEE FOR RETURNED CHECKS.
   When any check, draft, or money order given by or for a customer to any of the city's utilities or its Frankfort Municipal Utility Office in payment for utility service or other charge is returned to the utility or the office by the drawer's bank because of the drawer's insufficient funds in such bank account or because such drawer has no such open account at such bank, then the customer shall be charged an additional service fee of $25, or 5% of the amount of the returned check, whichever greater, for each time the check is so returned by the bank.

§ 50.40  FEE FOR SERVICE CALLS.
   When a request is made by or for a customer to the City Light and Power Plant for a service call, and upon making the service call, the utility's serviceman determines that the customer's problem is not the fault of the utility, then the customer shall be charged a service fee for each such service call made, as follows:
   (A)   If the service call is made by the serviceman between the hours of 7:00 a.m. and 4:00 p.m., a fee of $60.
   (B)   If the service call is made by the serviceman after 4:00 p.m. and prior to 7:00 a.m. the next day, a fee of $150.

§ 50.41  NET METERING.
   (A)   The findings and determinations set forth in the Preamble to Ordinance10-03 are hereby made findings and determinations of the Council.
   (B)   The city encourages interested citizens and businesses to invest in renewable electric energy generation systems and enter into a net metering program with the municipal electric utility of the city.
   (C)   Eligible net metering customers include residential, commercial and industrial customers in good standing that own and operate a solar, wind, biomass, geothermal or hydroelectric generating facility that:
      (1)   Has a nameplate capacity less than or equal to ten kilowatts(kw);
      (2)   Is located on the customer's premises and is operated by the customer; and
      (3)   Is used primarily to offset all or part of the customer's own electricity requirements.
   (D)   The Council authorizes the utility to offer net metering to eligible net metering customers on a first come, first served basis.  The utility shall limit the aggregate amount of net metering facility nameplate capacity from all net metering customers to 0.1% of the utility's most recent summer peak load.
   (E)   The utility shall measure the difference between the amount of energy delivered by the utility to the net metering customer and the amount of energy generated by the net metering customer and delivered to the utility.  If the net metering customer generates more energy than it consumes in a month, the customer shall receive a bill credit from the utility for the amount of surplus energy generated.  The utility shall not purchase or wheel power produced by an eligible net metering customer's facilities.
   (F)   The Net Metering Tariff attached to Ordinance 10-03 and incorporated herein by reference shall be adopted as the terms and conditions under which the utility will offer net metering to eligible net metering customers.
   (G)   In accordance with the Net Metering Tariff, the utility shall enter into an interconnection agreement with the eligible net metering customer prior to connecting the customer's net metering equipment to the utility's system.  The connection agreement shall incorporate technical interconnection requirements and applicable provisions of the Net Metering Tariff, and shall not be in conflict with the terms of this section.

§ 50.42  METER TEST FEE.
   When a request is made by a customer for a meter test, and the customer has already received a free meter test within the 12-month period in which the request is made, the customer shall be charged a fee of $33 for the additional meter test.
