SECTION 6. CIVIL SERVICE COMMISSION.
   The Mayor shall appoint three electors of the City as a Civil Service Commission to serve for a term of six years, except that of the three appointed for the terms beginning January 1, 1952, one shall be appointed for a term of two years, one for a term of four years, and one for a term of six years.
   The Mayor shall fill any vacancy in the Commission for the unexpired term. The Civil Service Commission shall designate one of its members as President and shall appoint a Secretary, who may be a member of the Commission, and such other employees as may be necessary. The Council may make the necessary appropriations to carry out the Civil Service provisions of this Charter.
SECTION 7. DUTIES OF THE CIVIL SERVICE COMMISSION.
   The Civil Service Commission shall provide by rule for the ascertainment of merit and fitness as the basis for appointment and promotion in the service of the City as required by the Constitution of Ohio, and for appeals from the action of the Mayor in any case of transfer, reduction, or removal. The action of the Commission on any such appeal shall be final except as otherwise provided by the Laws of Ohio. Civil Service examination shall not be required for the appointment of any member of a board or commission, or any head of a department other than the Police Department or Fire Department, or any assistant to a director, or any secretary to the Mayor or to the head of any department, or any assistant to the Mayor, or for temporary appointments or for unskilled laborers, or for appointment to any other office or position requiring peculiar and exceptional qualifications. The Civil Service Commission may provide by rule for the extension of the one-year probationary period for Police and Fire Department employees for a period not to exceed three years. Nothing herein contained shall affect the present status of any employee of the City now under Civil Service. Except as herein provided, the Civil Service Commission shall determine the practicability of competitive examination for any nonelective office or job classification in the service of the City. The Director of Finance shall make records of salary or compensation to any person holding a position in the classified service available for audit by the Civil Service Commission. Any sums paid in error as determined through such audit may be recovered by the City.

SECTION 8. THE BOARD OF CONTROL.
   The Mayor, the Chairman of the Council Finance Committee, or the Chairman's designee from among the members of Council, and the directors of the several departments, established either by this Charter or by ordinance, shall constitute a Board of Control. The Mayor shall be ex-officio President. The Director of Finance shall be Secretary. The Board shall keep a journal of its proceedings. The voting shall be taken by "yeas" and "nays" and entered in the journal, and the vote of a majority of all of the members of the Board shall be necessary to adopt any question, motion, or order. All meetings of the Board shall be open to the public. The Council of the City of Euclid shall establish minimum expenditure levels requiring approval by the Board of Control. The Board shall have such further powers and perform such further duties as shall be prescribed by ordinance.
SECTION 9. THE CITY PLANNING AND ZONING COMMISSION.
   The City Planning and Zoning Commission shall consist of five electors of the City not holding other Municipal office, to be appointed by the Mayor for a term of six years, except that of the five appointed for the terms beginning January 1, 1952, two shall be appointed for a term of two years, two for a term of four years, and one for a term of six years. A vacancy occurring during the term of any member of the City Planning and Zoning Commission shall be filled for the unexpired term in the manner authorized for an original appointment.
SECTION 10. DUTIES OF THE PLANNING AND ZONING COMMISSION.
   The City Planning and Zoning Commission shall have such powers and duties as shall be conferred upon it by ordinance of the Council concerning the plan, design, location, removal, relocation, and alteration of any buildings or structures owned by the public or located on public streets or public property; the location, relocation, widening, extension, and vacation of streets, parkways, playgrounds, and other public places; the approval of plats for the subdivision of land; and the zoning of the City for any lawful purpose or purposes. Any and all items pertaining to planning and zoning, whether public or private lands are involved, are to be presented to the Planning and Zoning Commission for consideration prior to any final, formal approval by Euclid City Council.

SECTION 11. THE DEPARTMENT OF RECREATION.
   The Department of Recreation shall be under the supervision and control of a Director of Recreation who shall be appointed by, and serve at the pleasure of the Mayor. The Director of Recreation shall perform such other duties and functions in connection with the public recreation of the City, and have such further power as may be provided by ordinance. All gifts or funds obtained from levies for recreational purposes, including those for land, improvements and operation, or appropriated by other public bodies, or donated for such purposes to the City, shall be received by the City Council for recreational purposes only. The Council may authorize cooperative agreements for the acquisition, operation and maintenance of playgrounds, gymnasiums, swimming pools or beaches, and recreational centers.
   For the purpose of developing and planning recreational programs, and the fees to be charged therefor, a Recreation Commission of five members shall be appointed by the Mayor of the City of Euclid. The Director of the Department of Recreation shall be a permanent ex- officio member of the Recreation Commission. One member shall be a member of the Board of Education of the Euclid City School District, one member shall be a member of Euclid City Council, and the remaining three members shall be electors of the City not holding other public office. The members of the Recreation Commission shall be appointed by the Mayor for a term of two years, except that of the four appointed for the terms beginning January 1, 1985, two shall be appointed for a term of two years, and two for a term of one year. The term of the third elector appointed pursuant to this amendment shall coincide with and shall expire at the same time as the term of the two electors currently appointed. A vacancy occurring during the term of any member of the Recreation Commission shall be filled for the unexpired term in the manner authorized for an original appointment. The Commission shall elect a chairman and a secretary, and it shall adopt rules and regulations for the conduct of all business within its jurisdiction. No member of the Commission may serve as chairman for more than one year consecutively. The previously appointed and duly acting Recreation Commission shall expire and have no authority on and after December 31, 1984, and the new Recreation Commission shall take office pursuant to the terms of this section on and after January 1, 1985.

SECTION 12. POLICE AND FIRE DEPARTMENTS.
   The Chief of Police and the Chief of the Fire Department shall have exclusive right to suspend without pay any of the deputies, officers, or employees in their respective Departments and under their management and control for a period of up to fifteen days. An employee who is suspended for a period longer than five days shall have the right to appeal the case to the Mayor/Ex-Officio Safety Director. Subsequent appeals shall be made to the Civil Service Commission or through the procedure contained in the applicable collective bargaining agreement. The appeal procedure exercised shall be exclusive.
