1703.35 AUTHORIZED REPRESENTATIVES.
   Whenever in this Code an administrative officer is directed or empowered to perform duties or exercise authority, it shall be interpreted to mean such administrative officer or his or her duly authorized representative or inspector.

1703.36 RIGHT OF ENTRY; INSPECTIONS; SEARCH WARRANT.
   (a)   Notwithstanding the limitations provided in division (c) of this section upon presentation of proper credentials, the Commissioner of Buildings, or the Housing Manager, or his or her duly authorized representatives, may enter at reasonable times any building, structure or premises in the City to perform any duty imposed on him or her by this Code.
   (b)   The Building Commissioner, Housing Manager, and their duly authorized representatives, are hereby authorized to make or cause to be made inspections of all structures or premises used for dwelling purposes, and of all secondary or appurtenant structures, to determine whether such structures or premises conform to the provisions of this code.
   (c)   Except in emergency situations, if the owner, manager or agent acting for the owner of a structure or premises used for dwelling purposes refuses entrance to the Building Commissioner, Housing Manager or their duly authorized representatives for purposes of inspection, no such entrance or inspection shall be made unless a search warrant is properly obtained from a judge of a court of competent jurisdiction. No penalty under the penalty provisions of this Building and Housing Code shall apply against such owner who refuses entrance until such search warrant is obtained.

1703.365 PERMISSION TO ENTER ADJOINING PROPERTY.
   (a)   For the purpose of performing repairs, alterations or maintenance on the interior or exterior of any dwelling, building or other structure, and as necessary to effect compliance with this Building and Housing Code and any other City ordinance, or rules adopted or orders issued pursuant thereto, a property owner or his or her agent shall request from the adjoining property owner the necessary permission to enter upon the adjoining property for the purpose of making such improvements. If such permission is refused, the property owner shall contact the Building Commissioner or his or her designee who shall then conduct an investigation into the necessity of entering onto the adjoining property for the purpose of making such improvements. The Commissioner shall make a written report of his or her findings concerning the requested permit and the necessity thereof and forward a copy to all individual parties.
   (b)   Upon good cause shown, the Commissioner shall then issue a permit authorizing the entrance upon the adjoining property for the purpose of making such improvements. The permit issued shall specify the time and day or days when the improvements shall be made. The work shall start no earlier than 9:00 a.m. and shall cease no later than 6:00 p.m., Monday through Saturday. The Commissioner shall advise the adjoining property owner of the issuance of any such permit.
   (c)   The permit holder shall be obligated to correct any damage done to the adjoining property as a result of the accomplishment of the work, and shall restore the adjoining property owner's premises to the same condition as when he or she entered thereon. The permission to enter upon the adjoining property shall be minimized to the shortest time practical to complete the improvements.
   (d)   Section 541.05 of these Codified Ordinances shall not apply to any person who enters upon adjoining private property in compliance with the terms of any permit issued by the Building Commissioner pursuant to this section.

1703.37 RECORDS.
   The Commissioner of Buildings shall keep permanent, accurate records of all the business of the Division of Buildings. The records of the Division shall also include data submitted by applicants on subsoil conditions, log of borings, tests for soil-bearing capacities and bearing power of foundation piles, together with the location of the building or premises to which they relate.
   The Housing Manager shall keep permanent and accurate records of all the business of the Department of Housing. The records of the Department shall also include any and all pertinent information gathered by the Housing Manager or the designated Department Inspector relating to occupants, owners or activity on the property in violation of this Code.

1703.38 REPORTS.
   The Commissioner of Buildings and the Housing Manager shall submit a report to the Mayor not less than once a year covering the work of the Division of Buildings during the preceding period. He or she shall incorporate in the report a summary of his or her recommendations as to desirable amendments to this Code.
