6-6-2-4: TRASH CONTAINERS TO BE KEPT ON PREMISES:
   (A)   No trash containers shall be placed within the limits of any street or alley but shall be kept by the adjacent property owner upon his own property.
   (B)   It shall be the duty of all persons occupying or controlling any residential dwelling unit to place trash containers at the curb line of the premises on the day of collection.
   (C)   All trash containers shall be stored and maintained in a neat manner complementary to the area and the neighborhood. (Ord. 425, 4-9-1981)
6-6-2-5: INTERFERENCE WITH CONTAINERS:
   (A)   It shall be unlawful for any person, other than the owner, occupant or members of their families, the owner's agent, or the village to deposit, remove, deface, destroy, or disturb trash containers, recycling containers, or bulky wastes.
   (B)   From time of placement of recyclables at the curb or in recycling drop boxes for collection in accordance with the terms hereof, items shall be and become the property of the village or its authorized agent. It shall be a violation of this chapter for any person not authorized by the village to collect or pick up or cause to be collected or picked up any such items. Any and each such collection in violation hereof from one or more locations shall constitute a separate and distinct offense punishable as hereinafter provided. (Ord. 425, 4-9-1981)
6-6-2-6: PLACEMENT AND STORAGE:
   (A)   It shall be unlawful for any person to sweep or deposit any refuse or litter in any public place or public way except in public trash containers provided for such purposes. Persons owning or occupying property shall keep the sidewalk and any right of way bordering their property free of litter.
   (B)   It shall be unlawful for any person to deposit any residential refuse in any public place or public trash container.
   (C)   It shall be unlawful for any person to place or maintain paper, litter, excelsior, garbage, trash or rubbish of any kind whatever in open deposits on the ground or in open containers which do not meet the requirements of this chapter.
   (D)   It shall be unlawful to use any nonapproved container in violation of the provisions of this chapter. Such containers may be confiscated and disposed of by the village.
   (E)   It shall be unlawful for any person to place or maintain garbage, rubbish, recyclables or trash for curbside collection in violation of this chapter.
   (F)   It shall be unlawful for any person to place or deposit residential refuse in any commercial container. (Ord. 425, 4-9-1981)
6-6-2-7: POLLUTION OF WATER, STREETS:
   (A)   No person shall throw, place, or deposit or cause to be deposited any garbage, refuse, litter, manure, carrion, dead animals, offal, putrid, or unwholesome substance, upon the margin, banks or into any stream or water, or another within the limits of the village.
   (B)   No person shall allow or permit any litter, other offensive substance, or noxious matter of any kind to run or fall from or out of any building or vehicle into or upon any street or public place, nor allow or permit such litter or other noxious matter to stand or remain on any ground or premises within the limits of the village. 6-6-2-8: COLLECTION REQUIRED:
In the interest of community health standards, it shall be required that all residential, commercial, and industrial properties within the corporate limits of Erie provide for garbage-refuse collection no less frequently than once per week. (Ord. 425, 4-9-1981)
6-6-2-9: COLLECTION PROVIDED BY VILLAGE:
   (A)   For purposes of providing village collection services, properties within the corporate limits shall be classified as follows:
      1.   Residential: Single-family residential properties, multi-family residential dwellings, or single unit apartment housed on the same property as a commercial establishment.
      2.   Commercial-Industrial: Properties with the principal use being a business enterprise, or those properties not being classified as residential. This classification includes, but is not limited to: restaurants, retail sales establishments, medical offices, schools, churches, and nonmanufacturing facilities.
   (B)   The village shall provide once per week collection of solid waste from residential properties only. No collection service shall be provided to commercial or industrial properties.
   (C)   The materials to be collected include:
      1.   Garbage and rubbish.
      2.   Bulky waste.
      3.   Yard waste in accordance with the provisions of section 6-6-2-12 of this chapter.
      4.   Recyclable materials, including glass, plastic (HDPE and PET), newspapers, and cans when packaged in accordance with this chapter.
   (D)   The village will not collect sod, earth, concrete, refuse from remodeling or construction, automobile parts, hazardous wastes, and large trees. (Ord. 425, 4-9-1981)
6-6-2-10: HOUSEHOLD REFUSE COLLECTION:
Collection of household refuse will be provided once each week from all residential properties. Refuse must be placed curbside. All refuse shall be prepared for collection in the following manner:
   (A)   Any refuse placed in containers for collection shall be drained of all free liquids and shall be less than thirty five (35) pounds.
   (B)   It shall be unlawful for any container to be filled with materials which may cause injury to persons handling the containers including, but not limited to, explosives, poisons, acids or caustic materials.
   (C)   Fats, oils, and grease shall be placed in sealed containers to prevent leakage.
   (D)   Containers shall be free of any landscape (yard) waste materials. (Ord. 425, 4-9-1981)
6-6-2-11: CURBSIDE RECYCLING SERVICE:
   (A)   The village shall cause to be collected and removed all recyclable materials which are placed in recycling bins at the curbside adjacent to residential properties and other locations agreed by the village to be enrolled in the recycling service.
   (B)   The village shall furnish one recycling container for each residential dwelling unit and to each person, firm, or corporation agreed by the village to be eligible to participate in the curbside recycling service. The container shall be owned by the village and shall remain village property at all times. Any container damaged or lost, except for the fault of the village or its agent, shall be replaced at the expense of the person, firm, or corporation using the recycling service. A replacement charge of ten dollars ($10.00) shall be assessed for any container not returned to village hall when service is permanently discontinued for any reason. (Ord. 425, 4-9-1981)
   (C)   All recyclable materials shall be prepared for collection and arranged in the recycling container as may be provided by rules and regulations issued by the disposal company and approved by a majority vote of the board of trustees. (Ord. 564, 8-12-2003)
6-6-2-12: YARD WASTE COLLECTION:
The village shall not provide for the collection of yard waste from residential properties except as may be collected by each individual hauler at the hauler's sole discretion. (Ord. 425, 4-9-1991)
