DUTCH ELM DISEASE

6-3-1: NUISANCE DECLARED:
   (A)   Any tree or part thereof, whether living or dead, infected with or attacked by Ceratocystis ulmi (the Dutch elm disease) is hereby declared to be a nuisance. It shall be unlawful to permit any tree or part thereof so infected to remain in the village.
   (B)   Trees or parts thereof of elm in a dead or dying condition and all other elm material, including woodpiles, that may serve as breeding places for the European elm bark beetle or that may harbor the Dutch elm disease fungus, are hereby declared a public nuisance. It shall be unlawful to permit any such tree or part thereof or any such elm material to remain in the village. (Ord. 198, 8-15-1960)
6-3-2: INSPECTION:
The members of the street, sidewalk and lights committee, or any member thereof, of the village are hereby authorized to inspect and examine any tree in the village to determine whether or not it is infected by the Dutch elm disease and to inspect and examine any woodpiles and other wood materials to determine if the same contain any dead elm wood. Upon discovering that any such tree is so infected or upon discovering the existence of any woodpile containing dead elm wood, the owner or occupant of the premises shall be notified of this fact.
