All scales used for weighing foodstuffs shall be placed on the front counter and at a distance of not more than three feet from the customer, so that the customer's side of the scales will show the pounds and ounces, whereby the customer may see the weight of the article or commodity being purchased at the time of purchase. No person shall use such scale until it is placed in the proper position. The use of such scale shall be deemed in violation of the provisions of this chapter until the position thereof has been approved and the scales properly tested by the City Sealer. This section in no way makes prepackaging scales illegal when packages are properly labeled as hereinafter provided.

There shall be a minimum charge of ten dollars ($10.00) for each trip that the City Sealer makes in the carrying out of his or her duties as set forth in this section.

No person shall use or cause to be used, or keep to be used, or house in his possession to be used, for weighing or measuring any article, commodity or thing to be bought or sold or offered or exposed for sale, any weight, measure, yardstick, tapeline or other linear measures, scales, beams, steelyards, platform scales, computing scales, gasoline, oil or other measuring pumps, or other machinery, appliances, utensils or receptacles for the use of weighing or measuring which are liable to or do indicate a false or inaccurate weight or measure, or any weighing or measuring device which can be manipulated so as to cause a false or inaccurate weight or measure, or which does not conform to the provisions of the standard established by the Ohio Department of Agriculture, or any scale or other device for weighing or measuring which is liable to indicate a false or inaccurate weight or measure by reason of its original imperfection or by being badly worn, rusted or by any other cause. Further it shall be the duty of the City Sealer and he is authorized and directed to seize any and all such weights, measures, yardsticks, tapelines or other linear measures, scales, beams, steelyards, platform scales, computing scales, utensils, appliances, or receptacles or other devices for weighing or measuring and destroy the same within seventy-two hours after such seizure, unless such scales and other devices for weighing and measuring can be repaired.

No person shall use any weighing or measuring devices which have not been sealed according to law, in buying or selling of any article, commodity or thing, or in computation of charges for services rendered on the basis of weight of measure, or dispose of any condemned weight or measure or weighing device, or remove the "Condemned" or "Out of Order" mark or tag placed thereon by the City Sealer or his deputies without his consent, or sell or offer for sale or expose for sale any article, commodity or thing or service, contrary to law, or give false weight or measure.

The standards used by the City Sealer to test weights and measures shall conform to standards established hy the Ohio Department of Agriculture. Council, at the expense of the City, shall provide and maintain the necessary and approved standards with these several necessary subdivisions for the purpose of testing and approving the weights and measures to be used in the City.
