4-1-1: DEFINITIONS:
As used in this chapter, the following terms shall have the meanings as set out in this section:
ABANDON: The act of relinquishing the care, custody and control of an animal without provision for adequate food, water or shelter. An animal that is left in the metropolitan animal control facility for the period of time described in section 4-1-7, subsections 4-1-8D, 4-1-9A, 4-1-13A, and 4-1-14D through F of this chapter, shall be deemed abandoned.
ALTERED: Spayed or neutered.
ANIMAL: Every living dumb creature, domestic or wild.
ANIMAL CONTROL DISTRICT: The town of Bar Nunn, Wyoming.
ANIMAL CONTROL OFFICER: Any person designated by the metropolitan animal control facility or joint powers board as a law enforcement officer who is qualified to perform such duties under the laws of this state.
ANIMAL CONTROL SHELTER: Any facility operated by a municipal agency, joint powers agency or its authorized agents for the purpose of impounding or caring for animals held under the authority of this chapter or state law.
AT LARGE: A dog is deemed "at large" if it is off the premises of the owner and the dog is not under restraint or is not under control of the owner. A cat is deemed "at large" if it is on private property without prior permission of the property owner and does not wear a valid license tag attached to its collar, or does not bear a tattoo or microchip implant which is currently registered with the metropolitan animal control facility. A laying chicken hen is deemed "at large" if it is off the premises of the owner. "At large" shall also mean and shall also include any "domesticated animal" which:
   A.   Molests people or passing vehicles (including bicycles);
   B.   When off the premises of the owner, attacks other domestic animals;
   C.   Trespasses on school grounds or private property without prior permission of the property owners;
   D.   Damages private or public property;
   E.   Is an unrestrained female dog or cat in heat;
   F.   Presents a traffic hazard.
BOARD: The metro animal control and welfare joint powers board.
CAGE AND AVIARY BIRDS: Exotic captive reared birds, such as parrots, exotic finches, and canaries, which are adapted to live and breed in a cage.
CAT: A domesticated feline.
CIRCUS: Any nonresident variety show which features animal acts.
CITY-COUNTY HEALTH OFFICER: A representative of the Natrona County-city of Casper health department or a health official designated by the city manager.
CONTROL: An animal which:
   A.   Is physically capable of hearing normal commands and is obedient to those commands;
   B.   Is, at the time under consideration, within reasonable proximity to the controller, so that shouting or excessively loud commands are not necessary.
DIRECTOR: The director of metro animal control and welfare.
DOG: A domesticated canine.
DOMESTICATED ANIMAL: Dog, cat, or ferret that has been made tractable and tame, and laying chicken hens.
FOWL: Any of the following, but shall not be limited to: chicken, turkey, goose, duck, emu, peacock, rhea, etc.
ISOLATION FACILITY: Any place specified by an animal control officer, police officer or county health officer which is equipped with a pen or cage which isolates an animal from contact with other animals.
KENNEL OR CATTERY: Any premises wherein any person engages in the business of boarding, breeding, buying, letting for hire, training for a fee, or selling dogs or cats, or any residence or property on which is maintained more than three (3) dogs and/or cats more than six (6) months of age.
LAYING CHICKEN HEN(S): A domesticated chicken hen of egg laying age.
LICENSING AUTHORITY: The metropolitan animal control facility.
LIVESTOCK: Any of the following, but shall not be limited to: horses, cattle, swine, sheep, mules, llamas and goats.
MAC: Metro animal control.
MICROCHIP IMPLANT: Any implant of a computer chip placed under the skin of any animal for identification. (See also definition of Tattoo.)
OWNER: Any person, partnership or corporation, or their agents, owning, keeping or harboring one or more animals. An animal shall be deemed to be harbored if it is fed or sheltered for three (3) consecutive days or more.
PROPER SHELTER: Natural or artificial shelter appropriate to the local climatic conditions for the species concerned, as necessary for the health of the animal.
PUBLIC NUISANCE: Any domesticated animal at large, or any dog that barks, whines or howls in excessive, continuous or untimely fashion.
RABBITRY: Any location where more than three (3) rabbits older than four (4) months of age are kept, except any place for the slaughtering of rabbits for which a permit has been obtained, and other provisions of this code or other ordinances of the town complied with.
RABIES CERTIFICATE: A certificate signed by a licensed veterinarian verifying that an animal is vaccinated against rabies, and which includes the date of immunization, the date that the immunization expires and the type of vaccine used.
RESTRAINT: An animal shall be considered under "restraint" if it is within the real property limits of its owner, or secured by a leash no longer than ten feet (10') in length.
TATTOO: A permanent mark placed on the skin of an animal. This mark must be composed of numerical or alphabetical symbols placed in the animal's hind legs or ears. It is the owner's responsibility to keep the tattoo visible and readable, including shaving the tattooed area, if necessary. (See also definition of Microchip Implant.)
THEATRICAL EXHIBITS: Any exhibition or act featuring performing animals.
VETERINARY HOSPITAL: Any establishment maintained and operated by a licensed veterinarian for the boarding of animals or the diagnosis and treatment of diseases and injuries of animals.
VICIOUS ANIMAL: Shall mean and include:
   A.   Any animal which, without provocation, approaches in an endangering or terrorizing manner, any person in determined attitude of the attack upon the streets, sidewalks or any public ground or place; or
   B.   Any animal with a known propensity, tendency or disposition to attack unprovoked, to cause injury or to otherwise endanger the safety of human beings or domestic animals; or
   C.   Any animal which bites, inflicts injury, assaults or otherwise attacks a human being or domestic animal without provocation on public or private property; or
   D.   Any animal owned or harbored primarily or in part for the purpose of vicious animal fighting, or any vicious animal trained for vicious animal fighting.
No animal may be declared a vicious animal if the animal was protecting or defending a human being within the immediate vicinity of the vicious animal from an unjustified attack or assault.
Any animal declared a vicious animal must bear a tattoo or microchip implant registered with animal control.
WILD ANIMAL OR EXOTIC PET: "Wild animal" or "exotic pet" means:
   A.   Any animal that is not customarily domesticated in the United States; or
   B.   Any species prohibited or regulated by the state of Wyoming by statute; or
   C.   Any mix or breed of any of the species mentioned above.
WORKING DAY: A day that the animal control shelter is open to the public.
ZOOLOGICAL GARDEN: Any facility, other than a pet shop or kennel, displaying or exhibiting one or more of nondomesticated animals by a person, partnership, corporation or government agency. (Ord. 99-04, 11-16-1999; amd. Ord. 2016-04, 9-6-2016)
4-1-2: ENFORCEMENT:
The provisions of this chapter shall be enforced by sworn officers acting under contract with or under approval of the town and animal control officers. It is unlawful and a violation of this chapter to interfere with an animal control officer in the performance of his duties, or to fail to obey the lawful order of an animal control officer. 4-1-3: LICENSE REQUIREMENTS:
   A.   Dogs And Cats:
      1.   It shall be unlawful for any person to own, keep, harbor or have custody of any dog or cat over six (6) months of age, within the Town, unless such dog or cat is licensed in accordance with this Chapter. This requirement does not apply to dogs or cats whose owners are not residents, if such animals are not kept in Town any longer than thirty (30) days, and while in Town, such animals are kept under restraint; or to seeing eye dogs properly trained to assist blind persons or to properly trained hearing- ear dogs.
      2.   Dogs and cats must wear valid license tags at all times when off the premises of the owners. The owners of a dog or cat not previously declared "vicious", may have their dog or cat tattooed or have a microchip implanted; however, if one of the two (2) procedures is performed, the tattoo or microchip implant must be registered annually with the animal control facility. Having a dog or cat tattooed or microchipped does not relieve an owner from the obligation to have the said animals display a valid license tag. This does not apply to show animals during competition or to hunting dogs when actually engaged in hunting activities or in training for those activities.
      3.   Written application for licenses shall be made to the licensing authority (which may include the Town of Bar Nunn). The application shall include the name and address of the applicant, a description of the animal, a statement of the appropriate fee, and a certificate to be filled out by a veterinarian verifying that the animal has been vaccinated against rabies.
      4.   The licensing period is the same as set out in subsection B3 of this Section.
      5.   Upon acceptance of the license application and fee, the licensing authority shall issue a durable tag, stamped with an identifying number and the calendar year of issuance. If a person chooses to have his dog or cat bear a tattoo or microchip implant, that person shall register the tattoo or microchip implant annually with the animal control facility when purchasing a license for the dog or cat.
      6.   The licensing authority shall maintain a public record of the applications for all tags issued.
      7.   The license fees and costs shall be those established by Metropolitan Animal Control Facility for all altered or unaltered dogs and cats. A duplicate tag may be obtained upon payment of such costs as established by the Metropolitan Animal Control Facility.
      8.   No person shall use any license for any dog or cat other than the dog or cat for which it is issued.
   B.   Other Animals And Animal Uses:
      1.   Upon showing compliance with the regulations promulgated by the Town Clerk, a license shall be issued following payment of the applicable fee, as follows:
         a.   For each trained commercial guard dog, twenty dollars ($20.00);
         b.   For each kennel, cattery or pet shop, per year, fifty dollars ($50.00);
         c.   For any zoological garden or animal act, covering all animals, fifty dollars ($50.00).
      2.   No fee shall be required of any veterinary hospital, humane society or Municipal animal control facility.
      3.   The license fee shall cover one calendar year from the date of month in which the license is issued. A new license shall be obtained each year by every owner and a new fee paid. Upon change in ownership of an animal or facility, the new owner may have the current license transferred to his name for a one dollar ($1.00) transfer fee. (Ord. 99-04, 11-16-1999)
