A. Number; Terms:
1. Appointment: The membership of the planning and zoning board shall consist of seven (7) members appointed by the mayor, on the basis of their particular fitness for their duty on the planning and zoning board, by and with the consent of the village board of trustees. The members shall reside within the corporate limits of the village.
2. Terms: The members of the planning and zoning board shall serve respectively for the following terms or until their respective successors are appointed and qualified:
2 members for 1 year
2 members for 2 years
2 members for 3 years
1 member for 4 years
Thereafter, each new member appointed pursuant to this section shall serve a three (3) year term. Terms of office shall commence May 1 and expire on April 30 of the appropriate year.
3. Vacancies: All vacancies occurring during the year shall be filled as soon as practicable, and shall be filled for the unexpired term of the member whose seat has become vacant, in the manner herein provided for and by the statutes of the state. The appointment of any new member shall be by the mayor with the consent of the board of trustees.
B. Removal Of Members:
1. The mayor shall have the power to remove any member of the planning and zoning board for cause after written charges have been filed and after a public hearing has been held, if such hearing is demanded by the member so charged.
2. Any member missing three (3) consecutive meetings shall be reprimanded or dismissed from the planning and zoning board by the mayor, with the advice and consent of the village board of trustees after a public hearing as set forth herein. A new member shall hereafter be appointed as prescribed in this section.
C. Organization: Immediately following their appointment, the members of the planning and zoning board shall meet, organize, elect such officers as it may deem necessary, and adopt and later change or alter, rules and regulations of organization and procedure consistent with village ordinances and state laws.
One of the members of the combined planning and zoning board shall be designated by the mayor, with the advice and consent of the village board of trustees, as chair of the combined planning and zoning board, and shall hold that office for not more than a total of three (3) 3-year terms, and shall be limited to no more than a total of three (3) consecutive terms of office (i.e., not to exceed nine (9) consecutive years) as chair. The chair shall appoint a clerk for the board who shall make and keep a record of all its meetings and official acts.
D. Compensation: The members of the planning and zoning board shall be paid eighty and no/100 U.S. dollars ($80.00) per meeting attended. (1976 Code §§ 34.017, 34.025, and 150.017; amd. Ord. 23-09-28, 9-27-2023)
The planning and zoning board shall adopt its rules of procedure not in conflict with this code, village resolutions and ordinances or Illinois statutes, and may select or appoint such other officers as it deems necessary. The planning and zoning board shall keep minutes of its proceedings showing the vote of each member upon each question, or if absent or failing to vote, indicating such fact. (1976 Code § 150.017)
A. Meetings:
1. Regular: Meetings shall be regularly scheduled one weekday evening each month at a time and place as designated by the planning and zoning board; and in addition, the planning and zoning board shall hold meetings at the call of the chair and at such other times as the planning and zoning board or the corporate authorities may determine.
2. Cancellation And Adjournment: The combined planning and zoning board may, for cause, at any regularly scheduled monthly meeting or special meeting, adjourn or cancel a future regularly scheduled monthly meeting or a special meeting by a favorable vote of a majority of the members attending said regular or special meeting.
In the alternative, if it becomes apparent to the chair of the planning and zoning board that prior to any regular scheduled meeting or special meeting that a quorum will not be present at said meeting or there are no petitions, motions, applications, etc., ready for a regularly scheduled meeting or special meeting, the chair of the combined planning and zoning board may unilaterally cancel said future meeting by either a written notice to the members or, if time does not permit, by telephone notice to the members.
B. Hearings:
1. All hearings required to be conducted by the board shall be open to the public. Any person may appear and testify at a hearing, either in person or by duly authorized agent or attorney. All testimony shall be given under oath. The chair or vice chair, or his designee, shall administer oaths and may compel the attendance of witnesses.
2. No hearing shall be held without a quorum of the planning and zoning board, consisting of a majority of the members, being present. (Ord. 99-10-22, 10-18-1999)
3. Any formerly absent member who certifies in writing that he has read the file on any pending proceedings and any written transcript thereof, may vote upon any question presently before the board.
4. Every rule or regulation, every amendment or repeal thereof and every order, requirement, decision or determination of the planning and zoning board shall be immediately filed in the office of the village clerk and shall be a public record.
5. The concurring vote of four (4) members of the planning and zoning board shall be necessary to reverse any order, requirement, decision or determination of an administrative official, or to decide in favor of an applicant regarding any matter upon which it is required to pass under this code or to affect any variation or to recommend any variation or modification to the zoning ordinance or to make a text amendment pursuant to section 10-15-4 of this code. C. Records: The board shall keep written records of its proceedings, which shall be open at all times to public inspection, and shall also file an annual report with the mayor and village board of trustees, setting forth its transactions and recommendations. (1976 Code § 34.025)
The combined planning and zoning board shall have jurisdiction as to planning as set forth in 65 Illinois Compiled Statutes 5/11-12-4 through 5/11-12-12, and section 2-1-5 of this chapter; and shall have jurisdiction sitting as the zoning board of appeals as set forth in 65 Illinois Compiled Statutes 5/11-13-1 through 5/11-13-20, 5/11-14-1 through 5/11-14-4, 5/11-15-1 and 5/11-15.1-1 through 5/11-15.1-5, and title 10 of this code. A. Authority:
1. The planning and zoning board hereby created shall have the powers and duties designated by 65 Illinois Compiled Statutes 5/11-12-4 through 5/11-12-12, and as more particularly specified in this section. These references relate to the planning portion of the combined plan commission and zoning board of appeals.
2. In addition, as to the zoning powers and duties of the combined plan commission and zoning board of appeals, they are to be found in 65 Illinois Compiled Statutes 5/11-13-1 through 5/11-13-20, 5/11-15-1 and 5/11-15.1-1 through 5/11-15.1-5, and title 10 of this code. (1976 Code § 34.016)
B. General: The planning and zoning board shall have the following powers and duties:
1. To prepare and recommend to the village board of trustees a comprehensive plan of public improvements, looking to the present and future development and growth of the village. Such a plan, after its adoption by the village board of trustees, will be known as the official plan of Antioch and shall include reasonable requirements in reference to streets, alleys and public grounds within the corporate limits and in contiguous territory outside of and distant not more than one and one-half (11/2) miles from such limits, and not included in any municipality, said requirements to be effective whenever such lands shall be subdivided after the adoption of such plan.
2. To prepare and recommend to the village board of trustees from time to time, such changes in the plan or any part thereof as may be deemed necessary by the village board of trustees or by the plan commission.
3. To prepare and recommend to the village board of trustees from time to time, plans and/or recommendations for specific improvements in pursuance of the official plan.
4. To give aid to the officials of the village charged with the direction of projects for improvements embraced within the official plan, to further the making of such improvements and generally promote the realization of the official plan.
5. To arrange and conduct any form of publicity relative to its activities for the general purpose of public understanding.
6. To cooperate with municipal or regional planning commissions and other agencies or groups to further the local planning program and to assure harmonious and integrated planning for the area.
7. To exercise such powers germane to the powers granted under authority of an act of the general assembly of the state of Illinois entitled the Illinois municipal code 1 , as may be conferred by the village board of trustees.
C. Recommendations:
1. All recommendations and findings of the planning and zoning board shall be forwarded to the village board in a timely manner as dictated by the appropriate procedural sections of the zoning ordinance and subdivision code and this chapter. Such recommendations are advisory only and are not binding upon the corporate authorities.
2. The planning and zoning board shall submit such recommendation in writing to the mayor and village board within fifteen (15) days of public meeting where such recommendation is required. The village clerk shall keep written records of the board's proceedings, which shall be available at the village hall for public inspection during ordinary business hours. (1976 Code § 34.026)
D. Land Subdivisions: Following the adoption of an official plan in the manner as herein prescribed, no map or plat of any subdivision presented for record, affecting land within the corporate limits of the village or in contiguous territory outside of and distant not more than one and one-half (11/2) miles from such limits and not included in any other municipality, shall be entitled to record or shall be valid unless the subdivision thereon shall provide for streets, alleys and public grounds in conformity with any requirements applicable thereto of such official plan. E. Improvements: The village clerk shall furnish the plan commission for its consideration a copy of all ordinances, plans and data relative to public improvements of any nature. The plan commission may report in relation thereto if it deems a report necessary or advisable for the consideration of the village board of trustees. (1976 Code § 34.028)

The planning and zoning board may, at the discretion of the village board of trustees, employ necessary help whose salaries, wages and other necessary expenses shall be provided for by adequate appropriation made by the village board of trustees from the public funds. If said plan commission shall deem it advisable to secure technical advice or services, it may be done upon authority from the village board of trustees and appropriations by the village board of trustees therefor.
