§ 4-1-3 MINORITY BUSINESS ENTERPRISE PROGRAM.
   (A)   The city's Minority Business Enterprise Plan dated March, 1981, is hereby adopted by the city to be applied to projects receiving financial assistance from the Department of Transportation.
   (B)   Responsibility for the Minority Business Enterprise Program shall be assigned as follows:
      (1)   Policy. City Council, Mayor Administration: Chief administrative Officer and Minority Business Enterprise Officer with the support of the Affirmative Action Division, Purchasing Division and Transportation Department.
      (2)   Monitoring.
         (a)   Minority Business Enterprise Office - overall and general monitoring, internal investigation, and action.
         (b)   Purchasing Division and Affirmative Action Division - recommendations to the Mayor or Chief Administrative Officer.
         (c)   OCETA and Human Rights Office - selective monitoring through contract compliance activities.
      (3)   Evaluation. Minority Business Enterprise Task Force and Human Rights Board (as empowered by Human Rights Ordinance).
      (4)   Enforcement. Mayor, Chief Administrative Officer, and Minority Business Enterprise Officer.
   (C)   It shall be the responsibility of the Minority Business Enterprise Officer, under the direction of the Chief Administrative Officer and with the review and recommendations of the Minority Business Enterprise Task Force, to prepare and submit to the City Council for approval, guidelines setting forth standards and procedures for the city's Minority Business Enterprise Program. The guidelines shall comply with applicable federal, state and local laws, regulations and guidelines prohibiting discrimination in employment, and will take into account problems and progress in the city's effort to provide equal opportunity.
   (D)   It shall be the responsibility of the Minority Business Enterprise Officer to prepare and submit for the approval of the Mayor, Chief Administrative Officer and the City Council, a city Minority Business Plan. The Minority Business Enterprise Task Force shall review the plan and make recommendations for appropriate changes.
   (E)   It shall be the responsibility of the Chief Administrative Officer to amend the plan as necessary.
   (F)   In support of the Minority Business Enterprise Program, the City Council and the Mayor will ensure that adequate city resources are assigned to implement the program and the Mayor shall closely review and hold pertinent city management personnel accountable for the program's progress within their respective departments.
