§ 13-10-3 PROFESSIONAL FUND RAISER LICENSE REQUIRED.
   No person shall act as a professional fund raiser within the city unless he has first received a license from the Mayor to do so. Renewal license applications shall be applied for prior to March 16 of each year thereafter. Applications for a professional fund raiser's license shall be made to the Mayor on forms prescribed by the Mayor. Applications shall be accompanied by $100 which shall be nonrefundable. The license may not be prorated. The application shall contain the following information and any other additional information deemed necessary by the Mayor, consistent with the terms of this article:
   (A)   The name and address of the applicant, including principal place of business and local address and if the applicant is a corporation, the name and address of each of its managing officers and agents, and state of incorporation or if it is an unincorporated association, firm or partnership, the name and address of each member of such unincorporated association, firm or partnership.
   (B)   The names of any officer, director, trustee, partner, or any current agent or employee of the applicant professional fund raiser who have been convicted of a felony or a misdemeanor involving moral turpitude within the past seven years, and the nature of the offense, the state where the conviction occurred, and the year of such conviction.
   (C)   The general plan, character and method in or by which applicant proposes to conduct its or his business as a professional fund raiser. This information shall include a listing of charitable organizations with address and principal officers with which the applicant intends or expects to provide fund raising services during the licensing period and a statement signed by an authorized representative of each charitable organization stating that the organization intends to have the applicant raise funds for it.
   (D)   The applicant's state revenue division taxpayer identification number or evidence of application for a current revenue division taxpayer identification number as required by Section 3-38-4(C) NMSA 1978.
   (E)   Proof that the applicant has posted a bond in accordance with § 13-10-7 or an affidavit executed by the applicant that he or she will only raise funds for governmental entities provided that the governmental entities for which the applicant intends to raise funds have consented in writing to the applicant not having a bond. In the event the applicant executes such an affidavit, solicitation shall be limited to the governmental entities listed pursuant to division (C) above.
