A Board of Park and Recreation Commissioners is hereby created for the purpose of establishing, improving, developing, operating, and maintaining a municipal public park and recreation system, which shall be a public corporate body with perpetual existence and a corporate seal. It shall be known as the “Board of Park and Recreation Commissioners of the City of Weston”, and shall have power to purchase, hold, sell, and convey real or personal property; receive any gift, grant, donation, bequest, or devise; sue and be sued; contract and be contracted with; and do any and all things and acts which may be necessary or convenient to carry out and effectuate the purposes and provisions of this chapter.
(Prior Code, § 19-1)
(A) The Board of Park and Recreation Commissioners shall consist of five members, any three of whom shall constitute a quorum for the transaction of business, except as hereinafter in this chapter provided.
(B) The members of the Board shall be appointed by the Common Council. To establish the Board, the Common Council shall appoint the members of the first Board, such appointees to serve two for a term of six years, two for a term of four years, and one for a term of two years. Thereafter, the appropriate number of members of the Board shall be appointed in April of each even-numbered year, to take office on May 1 in the year of his or her appointment. Each member shall serve a term of six years and continue to serve until his or her successor is duly appointed and qualified. Any vacancy on the Board shall be filled by the Common Council.
(C) Membership on the Common Council shall not disqualify a person from serving on the Board, provided that not more than two members of the Common Council may be appointed to serve on the Board at one time.
(D) All members of the Board must be residents and freeholders of the city. When any member of the Board, during his or her term of office, shall cease to be a resident and freeholder of the city, he or she shall thereby be disqualified as a member of the Board and his or her office shall thereupon become vacant.
(Prior Code, § 19-2) (Ord. passed 11-3-2014)
(A) After appointment, the members of the Board of Park and Recreation Commissioners shall qualify by taking and filing with the City Clerk the oath prescribed by law for public officials, and they shall not be permitted to serve upon such Board until they have so qualified. If any member of the Board shall fail to so qualify on or before the date upon which he or she should assume the duties of his or her office, the other qualified members of the Board may declare his or her position vacant and appoint a successor as hereinbefore provided.
(B) (1) On the first Monday in January of each year, the members of the Board shall organize by electing one of their number President, and another Vice President, and by electing a Secretary who need not be a member of the Board.
(2) The Secretary shall keep an accurate record of all the fiscal affairs of the Board, and shall keep a minute book in which he or she shall record the proceedings and transactions of each meeting of the Board. The Secretary shall be paid such compensation for his or her services as the Board shall fix from year to year.
(3) The City Treasurer shall be ex officio Treasurer of the Board, and he or she shall take the oath prescribed by law and shall furnish bond as may be required by the Board.
(Prior Code, § 19-3)
(A) The members of the Board of Park and Recreation Commissioners shall receive no compensation for their services but they shall be entitled to reimbursement for any reasonable expenses incurred in the performance of their duties as members of the Board.
(B) They shall not be personally interested directly or indirectly in any contract entered into, by the Board, or hold any remunerative position in connection with the construction, operation, or maintenance of any of the property under their control as members of the Board.
(Prior Code, § 19-4)
