The police department shall maintain a suitable system of filing traffic accident reports.
The driver of a vehicle involved in an accident within the limits of this city shall file a report as and when required by the State of Iowa. Said report shall be filed with the Waterloo Police Department. Also, see Section 124. (Ord. #3256, 1/17/83; '91 Rev.)
All accident reports filed by a driver of a vehicle involved in an accident as required under this code and under Iowa Code §321.266 shall be in writing. The report shall be without prejudice to the individual so reporting and shall be for the confidential use of the department, except that upon the request of any person involved in the accident, the person's insurance company or its agent, or the attorney for such person, the department shall disclose the identity and address of the other persons involved in the accident and may disclose the name of the insurance companies with whom the other persons have liability insurance. The department, upon written request of the person making the report, shall provide the person with a copy of that person's report. The written report filed with the department shall not be admissible in or used in evidence in any civil or criminal case arising out of the facts on which the report is based.
All written reports filed by a law enforcement officer as required under Iowa Code §321.266 shall be made available to any party to an accident, the party's insurance company or its agent, the party's attorney, or the attorney general, on written request and payment of a fee. The fee for the copying service as determined by the Chief of Police shall not exceed the cost of providing the service. (Ord. #3408, 10/21/85; '91 Rev., ’99 Rev.; 03 Rev.) [Ref. Iowa Code §321.271]
The police chief may destroy any records of the department which have been maintained on file for three years, which the chief may deem obsolete and of no further service in carrying out the powers and duties of the department. However, this shall not apply to any records which are required to be kept for a longer period of time by the Iowa Code. ('91 Rev.; '95 Rev.) [Ref. Iowa Code §321.12]
