GENERAL PROVISIONS
§ 51.01 NATIONAL ELECTRICAL CODE ADOPTED.
   For the purpose of establishing rules and regulations to govern the use of electricity for lights, heating, power, radio, and for other purposes, the city hereby adopts the most recent version of the National Electrical Code as adopted by the State of South Dakota.

§ 51.02 CONFLICT OF LAWS.
   In case of conflict between the provisions of the National Electrical Code and this code, or with statutes of this state, the provisions of this code or state law shall prevail.

§ 51.03 OFFICE OF ELECTRIC SUPERINTENDENT CREATED; APPOINTMENT.
   There is hereby created the Office of Electric Superintendent for the city. He or she shall be appointed by the City Manager.

§ 51.04ELECTRIC SUPERINTENDENT ; DUTIES.
   (A)   The Electric Superintendent is hereby authorized and empowered to regulate, make, and determine the placing and installing of electrical wiring in and on buildings in this city so as to prevent fires, accidents, or injuries to persons or property and to cause all electrical appliances to be so placed or constructed and guarded as not to cause accidents or endanger lives or property.
   (B)   Whenever, in the judgment of the Electric Superintendent, any electrical wiring or appliances should be defective or dangerous, the Electric Superintendent shall inform the owner of the property containing the defective wiring or appliance to correct or remove the same.
   (C)   If the defective wiring or appliances have not been corrected forthwith, the Electric Superintendent may cause the building affected to be disconnected from the city electrical supply.
   (D)   To carry out his or her duties, the Electric Superintendent shall have the right at all times to enter any building, manhole, or subway, or to climb any pole upon which wires are placed or to be placed in discharge of his or her duty for the purpose of making any tests or inspection of electrical wiring or appliances therein contained.

§ 51.05 LICENSE FOR ELECTRICAL WIRING REQUIRED.
   Any person, before doing any electrical wiring or installing any electrical appliances in the city, shall secure from the Finance Officer a license therefore. The license shall be issued by the city to applicant or applicants competent to undertake the work of electrical wiring and installing electrical apparatus established by possession of a state electrical contractor’s or Class B license, upon payment by the applicant to the Finance Officer of an amount set from time to time by resolution. The license shall be good until June 30 of the following year, but shall not be valid for more than one year.

§ 51.06 CONSTRUCTION PERMITS REQUIRED.
   Any person, before entering upon the construction, erection, or wiring of any electrical work not covered by a state permit, must secure from the Electric Superintendent a construction permit. The permit shall describe in detail the proposed location, the plan of construction, material, and apparatus to be used before the construction certificate shall be issued by the Electric Superintendent. No permit shall be issued to any person without the license provided for by § 51.05. No alteration or change shall be made in the wiring of any building nor shall any building have wiring for the placing of electrical lights, motors, or heating devices without first securing a permit therefor, nor shall any change be made in any electrical plans after inspection by the Electrical Inspector without securing a new permit therefor.

§ 51.07 SERVICE ENTRANCE REQUIREMENTS.
   (A)   All new electric service entrance wires shall have a carrying capacity of 100 or more amperes between the point on any premises where the city service wires terminate and to the distribution panel. The distribution panel shall be designed to supply at least 8 separate circuits. The Electric Superintendent may authorize in writing the installation of wire of lesser capacity.
   (B)   In areas where existing overhead primary power lines are upgraded by replacing with underground primary power lines, the service lines shall also be replaced with underground service lines. The property owner will receive written notification from the city specifying number of days until existing overhead primary lines are de-energized. Since the point of service changes when overhead service lines are replaced with underground service lines, the City of Vermillion will pay the property owner a fee in an amount to be set by resolution for up to 100 feet as measured from the city’s point of termination to building foundation nearest existing service entrance to help defray the cost of this change in areas that are changed after the effective date of this section. This payment shall also be the consideration for easements required for the new power lines. Payment will be made after receipt of copy of contractor’s invoice or other evidence sufficient to the city.
   (C)   All electric meters now located on the interior of a private structure shall be relocated to the outside upon replacing overhead service with underground service. The City of Vermillion will pay the property owner a fee to be set by resolution to help defray the cost of this change in areas that are changed after the effective date of this section.

§ 51.08 RIGHT OF ENTRY FOR INSPECTION; OTHER POWERS OF CITY OFFICIALS.
   (A)   The City Engineer, the Electric Superintendent, or other officer or employee of the City Electric Department shall have the power to enter the premises or building of consumer at any reasonable hour for the purpose of reading, removing, installing, testing, or repairing meters or for examining wiring. Customer shall make the meter accessible without interference from pets and/or physical barriers.
   (B)   The official or employee shall have the power to shut the electricity off to any premises for nonpayment of electric bills, to enforce repair of service between meter and city infrastructure or for failure to provide access.
   (C)   The official or employee shall have the right to shut off any electric service for the purpose of repairs or improvements to the electric system.

§ 51.09 TAMPERING PROHIBITED.
   No person, except by permission of the Electric Superintendent, shall remove, repair, or tamper with any electric meter, or shall open any junction box or pedestal, or other part of the electric system.
