Nothing in this chapter shall be deemed to prohibit the city from making special agreements and assessing a special collection fee for the collection of items which the city or the exclusive franchise hauler does not normally collect, or for the city collecting excessive amounts of refuse.

Commercial customers who generate hazardous, toxic or special wastes must comply with federal and state laws, regulations and rules for the collection and disposal of such wastes. Disposal of these materials does not fall under the scope of the city’s exclusive franchise agreement.

(A) The disposal of any solid waste in any manner other than as designated by this chapter or sanctioned by the Solid Waste Manager is prohibited and is a violation of this chapter. It shall be unlawful to dispose of solid waste in a manner other than that specified by this chapter unless special arrangements are approved in writing by the Solid Waste Manager.
(B) Collection service may be discontinued when the provisions of this chapter are violated. Such collection service may be suspended until such prohibited activities have been stopped or deficiencies have been corrected to the satisfaction of the Solid Waste Manager.
