1420.06 PUBLIC RIGHTS-OF-WAY BOND REQUIRED.
   (a)   Bond Requirement. In addition to the fees set forth in this Chapter, every owner or building permit applicant, at the time of permit issuance, shall post a bond as hereinafter set forth to assure that the City shall be indemnified and held harmless against any damages, costs or other expenses incurred by the City resulting from or in any manner connected with the installation, maintenance, repair, cleaning of and/or removal of refuse, debris, or dirt from any existing or proposed public right of way, street, sidewalk, curb, gutter, easement, storm or sanitary line, ditch or swale by the City arising out of any act or omission of such owner, building permit applicant or its or their contractors, subcontractors, agents or employees.
 
   (b)   Bond Amount.  
      (1)   For each SDC occupancy, at the rate of:         $400.00
      (2)   For each OBC Use Group occupancy, at the rate of:    $1,000.00
 
   (c)   Bond Form. The bond required by this section shall be posted in cash at the time of the issuance of the permit.
 
   (d)   Forfeiture. All or a portion of the bond shall be forfeited if an owner or building permit holder fails to comply in a timely manner with a written notice served or posted by an officer or inspector of the City ordering compliance with an ordinance of the City which regulates or applies to such existing or proposed rights of way during any type of excavation, construction, grading, regrading or landscaping work.
 
   (e)   Return. The bond or the remainder thereof shall be returned to the permit holder when the City has determined that there has been satisfactory performance of all requirements of the Codified Ordinances regulating or applicable to such rights of way during such work.
